SIMILAR SERVICES. Customer acknowledges that iGrafx provides similar services and Deliverables to other clients and that nothing in this Agreement shall be construed to prevent iGrafx from carrying on such business. In the event that Deliverables contain Customer’s Proprietary Information, iGrafx has the right to retain and use internally copies of such Deliverables, provided, however, that the foregoing does not include rights to distribute, disclose or create derivative works from Customer’s Proprietary Information that is incorporated into the Deliverables. Customer acknowledges that the Software, Deliverables, and Documentation are not a “work made for hire” and Customer shall not sell, transfer, publish, disclose, display or otherwise make available the iGrafx Information. Notwithstanding any provision in this Agreement to the contrary, Customer shall acquire no right to any software under this Agreement.
