Common use of Shift Bidding Clause in Contracts

Shift Bidding. A. No less than once each year, each shift (including days off) within each section of the Water Supply and Treatment Division (▇▇▇▇▇ ▇▇▇▇▇ Water Treatment Plant, Sunol Water Treatment Plant and the Millbrae Corporation Yard) shall be open to bid. This provision shall not preclude the scheduling of additional shift bidding periods within particular bid units upon mutual agreement of Management and the Union. The annual shift bidding period required herein shall be integrated with transfer bidding in order to effect transfers and shift selections in a single integrated process at least once annually. Each location may have up to two shifts which shall be: Shift 1, 8:00 a.m. to 4:30 p.m., Shift 2, 3:30 p.m. to 12:00 a.m. or 4:00 p.m. to 12:30 a.m. The work week for both shifts at Water Supply and Treatment Division shall be Monday through Friday. B. Employees eligible to bid shall include all employees in the Water Supply and Treatment Division in class 7318, Electronic Maintenance Technician. C. At the time set by Management for the annual shift bidding period, the supervisor of each unit shall post for one (1) week shifts, and the number of employees in each classification to full such shifts, so that full-time employees described in paragraph B. above may submit their choices of shifts. Eligible employees who fail to submit timely bids, shall be assigned in the sole discretion of Management. D. Assignments shall become effective two weeks after the end of the posting period (or at the nearest commencement thereto of the next pay period) and shall be awarded in accordance with Water Supply and Treatment Division seniority in class above, except that Management may deny or delay bids that effect special projects or which require special skills or specific experience related to a specific job. E. Management shall retain the right between posting period to change an employee’s shift temporarily for training purposes or on account of unexpected operational demands. This period shall not exceed an aggregate of six (6) months for new hires and 120 days for existing 7318’s transferring in to the Water Supply and Treatment Division from other Public Utilities Commission Divisions or other Departments, provided the 120-day exclusion can be extended in the event the employee has yet to demonstrate the ability to satisfactorily perform duties. In the case of changed operational demands requiring permanent shift changes, Management shall attempt to meet its requirements to change employee’s shifts, first, through solicitation of volunteers, thereafter, by assignment by inverse seniority in the event insufficient voluntary shift changes are made to meet operational demands. Any person whose shift is changed involuntarily shall not be subject to the twenty-four (24) month exclusion rule contained in the transfer procedures notwithstanding that such employee may have been effected a successful transfer bid within twenty-four (24) months preceding an involuntary shift change pursuant to this provision.

Shift Bidding. A. No less 1. Regular full-time employees shall have the right to bid for available shift assignments based upon their placement on the seniority list in Appendix D, and within the affected classification, subject to the following provisions. 2. The new schedule shall be implemented no later than the beginning of the Water Supply first pay period in January. 4. Shift bidding for regular full-time employees’ schedules will be on a seniority basis within the affected classification and Treatment Division (all shifts that are bid upon shall be confirmed by the original initials of each employee, not a proxy. 5. In the event of a vacancy within the affected classification’s schedule, a shift bid will be initiated within 30-days of the vacancy. In such cases, the Employer may decide to bid all assignments in that classification or only assignments of employees ▇▇▇▇▇▇ ▇▇▇▇▇ Water Treatment Plant, Sunol Water Treatment Plant and to the Millbrae Corporation Yard) incumbent who vacated the then open position. The new schedule shall be open implemented by the Employer as soon as practicable, but not later than sixty (60) days upon completion of the bid. 6. Once a draft schedule has been established by a bid, management retains the right to bidexercise an override by changing an employee’s bid position in the event of exceptional circumstances. Bids subject to this provision shall be awarded in accordance with classification seniority as defined in Section 8 of the IBEW/CCSF Citywide M.O.U. unless subject to any exception contained herein. 4. At the time set by Management for the annual transfer/shift bidding period, the supervisor of each unit shall post for one (1) week the shifts, and the number of employees in each classification to full fill such shiftsshifts as well as the days off assigned each shift, so that full-time time, employees described in paragraph B. 2. above may submit their choices of shiftsshifts and days off. Eligible employees who fail to submit timely bids, shall be assigned in the sole discretion of Management. D. 5. Assignments shall become effective two weeks after the end of the posting period (or at the nearest commencement thereto of the next pay period) and shall be awarded in accordance with Water Supply and Treatment Division seniority in class 3. above, except that Management may deny or delay bids that effect special projects or which require special skills or specific experience related to a specific job. E. 6. Management by entering into this agreement does not waive its right to determine the number of shifts, the number of positions to be allocated to each shift, and the classifications of employees to fill such shifts which in Management’s sole determination it deems necessary to carry out the mission of the Department. 7. Management shall retain the right between posting period periods to change an employee’s shift temporarily (not to exceed an aggregate of six (6) weeks unless mutually agreed upon between the employee and Management) for training purposes or on account of unexpected operational demands. This period shall not exceed an aggregate of six (6) months for new hires and 120 days for existing 7318’s transferring in to the Water Supply and Treatment Division from other Public Utilities Commission Divisions or other Departments, provided the 120-day exclusion can be extended in the event the employee has yet to demonstrate the ability to satisfactorily perform duties. In the case of changed operational demands requiring permanent shift changes, Management shall attempt to meet its requirements to change employee’s employees’ shifts, first, through solicitation of volunteers, thereafter, by assignment by inverse seniority in the event insufficient voluntary shift changes are made to meet operational demands. Any person whose shift is changed involuntarily involuntary shall not be subject to the twenty-four (24) month exclusion rule contained in the transfer procedures notwithstanding that such employee may have been effected a successful transfer bid within twenty-four (24) months preceding an involuntary shift change pursuant to this provision.

This provision shall not preclude the scheduling of additional shift bidding periods within particular bid units upon mutual agreement of Management and the Union. The annual shift bidding period required herein shall be integrated with transfer bidding in order to effect transfers and shift selections in a single integrated process at least once annually. Each location may have up to two shifts which shall be: Shift 1, 8:00 a.m. to 4:30 p.m., Shift 2, 3:30 p.m. to 12:00 a.m. or 4:00 p.m. to 12:30 a.m. The work week for both shifts at Water Supply and Treatment Division shall be Monday through Fridayassignments based on seniority. B. Employees eligible to bid (b) Correctional Officer I with more than eighteen (18) months seniority not assigned under 3(b) above shall include all employees in the Water Supply and Treatment Division in class 7318, Electronic Maintenance Technicianreceive shift assignments based on seniority. C. At the time set by Management (c) Temporary assignments for the annual shift bidding period, the supervisor of each unit shall post for one (1) week shifts, and the number of employees in each classification to full such shifts, so that full-time employees described in paragraph B. above may submit their choices of shifts. Eligible employees who fail to submit timely bids, work crews shall be assigned in the sole discretion of Managementunder section 3(b) above. D. Assignments (d) Each facility shall become effective two weeks after open shift assignments to bidding as provided in this contract on the end following schedule: October 1 – March 31 August 1-15 September 1 April 1 – September 30 February 1-15 March 1 Each facility will open shift assignments not assigned under 3(b) above to bidding, and such assignments will be granted on the basis of seniority to those identified in subsection 5(a) & (b) above, provided however, implementation of the posting period (or at the nearest commencement thereto of the next pay period) and shift bidding process shall be awarded in accordance discussed with Water Supply and Treatment Division seniority in class above, except that the Department’s Labor Management may deny or delay bids that effect special projects or which require special skills or specific experience related to a specific jobCommittee. (f) Correctional Officer I’s who attain eighteen (18) months seniority between the six (6) months bidding cycle and persons promoted on a permanent basis to Correctional Officer II between the six (6) months bidding cycle, shall have their name placed on the bottom of the seniority roster for purposes of offering of assignments under subsection 5(e) above. (g) Correctional Officer I’s with less than eighteen (18) months seniority shall not have bidding rights under this subsection (h) Seniority under this Section (shift bidding) is defined as length of continuous Departmental service. The tie-breaker for employees having the same seniority shall be as follows: (i) Continuous Classified service; (ii) Earliest Month and Date of Birth in the event the employee has yet Calendar Year; (iii) Coin Flip. Employees who accept an interim assignment to demonstrate the ability to satisfactorily perform duties. In the case of changed operational demands requiring permanent shift changesanother classification for less than six (6) months and who returns, Management shall attempt to meet its requirements to change employee’s shifts, first, through solicitation of volunteers, thereafter, by assignment by inverse retain their seniority in the event insufficient voluntary shift changes are made to meet operational demands. Any person whose shift is changed involuntarily within that classification but shall not be subject able to the twenty-four (24) month exclusion rule contained in the transfer procedures notwithstanding that such employee may have been effected a successful transfer bid within twenty-four (24) months preceding an involuntary shift change pursuant to this provisionwhile absent.

Management shall make every effort to make such changes prior to Shift Bidding process. 34.2 Will be done bi-annually in April and October for Lieutenants, then Sergeants with the scheduling new shifts to take effect the first pay period following each July 1st and January 1st. 34.3 Will be done bi-annually in May and November for other Deputies with the new shifts to take effect the first pay period following each July 1st and January 1st. 34.4 After shift bids have been completed and Deputies have been assigned their days off, any Deputy who transfers from another shift at the Deputy's personal request, may not bump another Deputy from his days off or shift on the basis of additional seniority over that Deputy. 34.5 If a Deputy is transferred at the Department's initiative, he may bump on the basis of seniority. 34.6 Should a position become available on a shift after the yearly shift bidding periods within particular bid units upon mutual agreement of Management and the Union. The annual shift bidding period required herein shall be integrated with transfer bidding in order to effect transfers and shift selections in a single integrated process at least once annually. Each location may have up to two shifts which shall be: Shift 1, 8:00 a.m. to 4:30 p.m., Shift 2, 3:30 p.m. to 12:00 a.m. or 4:00 p.m. to 12:30 a.m. The work week for both shifts at Water Supply and Treatment Division shall be Monday through Friday. B. Employees eligible to bid shall include all employees in the Water Supply and Treatment Division in class 7318, Electronic Maintenance Technician. C. At the time set by Management for the annual shift bidding periodhas taken place, the supervisor of each unit shall post for one (1) week shifts, and position must be offered to the number of employees in each classification to full such shifts, so that full-time employees described in paragraph B. above may submit their choices of shifts. Eligible employees who fail to submit timely bids, shall be assigned in the sole discretion of Management. D. Assignments shall become effective two weeks after the end of the posting period (or at the nearest commencement thereto of the next pay period) and shall be awarded other personnel in accordance with Water Supply and Treatment Division seniority their seniority. 34.7 Any transfer resulting in class abovea change of work hours or days off shall require five (5) days written notice unless mutually waived or unless emergency needs of the Department dictate otherwise. 34.8 Bumping" will not be permitted when temporary days off change, except that Management may deny or delay bids that effect special projects or which require special skills or specific experience on the same shift, (not to exceed twenty (20) working days) is made to accommodate staffing demands. 34.8.1 Temporary transfers specifically related to rotation of personnel to accommodate the specific field training needs of newly hired sworn personnel will not exceed two (2) twenty (20) day periods, unless otherwise waived by the affected Deputy. This article does not apply to field training officers assigned a specific job. E. Management shall retain the right between posting period to change an employee’s shift temporarily newly hired sworn deputy for training purposes or on account of unexpected operational demands. This period shall not exceed an aggregate of six (6) months for new hires and 120 days for existing 7318’s transferring in to the Water Supply and Treatment Division from other Public Utilities Commission Divisions or other Departments, provided the 120-day exclusion can be extended in the event the employee has yet to demonstrate the ability to satisfactorily perform duties. Eligible employees who fail to submit timely bids, work crews shall be assigned in the sole discretion of Managementunder section 3(b) above. D. (g) Correctional Officer I’s with less than twenty (20) months seniority shall not have bidding rights under this subsection (h) Seniority under this Section (shift bidding) is defined as length of continuous Departmental service. The tie-breaker for employees having the same seniority shall be as follows: (i) Continuous Classified service; (ii) Earliest Month and ▇▇▇▇ of Birth in the event the employee has yet Calendar Year; (iii) Coin Flip. Employees who accept an interim assignment to demonstrate the ability to satisfactorily perform duties. In the case of changed operational demands requiring permanent shift changesanother classification for less than six (6) months and who returns, Management shall attempt to meet its requirements to change employee’s shifts, first, through solicitation of volunteers, thereafter, by assignment by inverse retain their seniority in the event insufficient voluntary shift changes are made to meet operational demands. Any person whose shift is changed involuntarily within that classification but shall not be subject able to the twenty-four (24) month exclusion rule contained in the transfer procedures notwithstanding that such employee may have been effected a successful transfer bid within twenty-four (24) months preceding an involuntary shift change pursuant to this provisionwhile absent.

Shift Bidding. A. No less than once (a) There will be a regular annual Shift Bid process started on the first full week after Labour Day each year, year for all bargaining unit employees. Additional plant-wide Shift Bids may occur throughout the year due to variations in crew and business needs and the procedures set out in this article will be followed. (b) The Shift Bid process will be as follows: (i) The number of available positions for each shift as set out in Article 11.02 will be posted on bulletin boards throughout the hangar and made available to employees on temporary assignment at other locations for a minimum of two (including days off2) within each section weeks prior to the start of the Water Supply shift bid process. (ii) The shift bid system will allow an employee to indicate their stated preferences for the various shifts posted. Employees must return their completed Shift Bid system no later than fourteen (14) calendar days after the start of the bid process. (iii) Employees will be assigned to a shift in order of their stated preferences subject to their seniority and Treatment Division having the required qualifications. Where an employee does not have the seniority or qualifications to hold a shift of their preference, they will be given an opportunity in seniority order to select one of the available shift vacancies. (▇▇▇▇▇ ▇▇▇▇▇ Water Treatment Plantiv) The results of the Shift Bid will be made accessible to the Plant Chairperson and/or Stewards at least seven (7) days prior to the revised schedule being posted. (v) Once the regular annual sign up is completed, Sunol Water Treatment Plant the list will be posted by October 15th of each year and employees will commence their new shifts on or about January 1st. The specific dates of commencement will be posted. (vi) For any other shift bids, there will be at least two (2) weeks notice to affected employees and the Millbrae Corporation Yard) shall be open Plant Chairperson prior to bid. This provision shall not preclude the scheduling of additional shift bidding periods within particular bid units upon mutual agreement of Management and the Union. The annual shift bidding period required herein shall be integrated with transfer bidding in order to effect transfers and shift selections in a single integrated process at least once annually. Each location may have up to two shifts which shall be: Shift 1, 8:00 a.m. to 4:30 p.m., Shift 2, 3:30 p.m. to 12:00 a.m. or 4:00 p.m. to 12:30 a.m. The work week for both shifts at Water Supply and Treatment Division shall be Monday through Fridaynew schedule commencing.
