Common use of Services Not Exclusive Clause in Contracts

Services Not Exclusive. The services furnished by the Sub-Adviser hereunder are not to be deemed exclusive, and except as the Sub-Adviser may otherwise agree in writing, the Sub-Adviser shall be free to furnish similar services to others so long as its services under this Agreement are not impaired thereby. Nothing in this Agreement contained herein shall be construed to limit or restrict the right of any director, officer or employee of the Sub-Adviser, Sub-Adviser (who may also be a trusteedirector, officer or employee of the Trust, Sub-Adviser) to engage in any other business or to devote his or her time and attention in part to the management or other aspects of any other business, whether of a similar nature or of a dissimilar nature.

Nothing in this Agreement shall limit or restrict the right of any director, officer or employee of the Sub-Adviser, who may also be a trustee, officer or employee of the TrustTrust or other investment company, to engage in any other business or to devote his or her time and attention in part to the management or other aspects of any other business, whether of a similar nature or a dissimilar nature.

Services Not Exclusive. The services furnished by the Sub-Adviser Adviser's services hereunder are not deemed to be deemed exclusive, and except as the Sub-Adviser may otherwise agree in writing, the Sub-Adviser shall be free to furnish render similar services to others so long as others. It is understood that persons employed by the Sub-Adviser to assist in the performance of its services under this Agreement are duties hereunder might not impaired therebydevote their full time to such service. Nothing in this Agreement herein contained shall be deemed to limit or restrict the right of the Sub-Adviser or any director, officer or employee affiliate of the Sub-Adviser, who may also be a trustee, officer or employee of the Trust, Adviser to engage in any and devote time and attention to other business or to devote his render services of whatever kind or her time and attention in part to the management or other aspects of any other business, whether of a similar nature or a dissimilar nature.

The performance of such services for others shall not be deemed to violate or give to duty or obligation to the Portfolio.

Services Not Exclusive. The services furnished by the Sub-Adviser hereunder are not to be deemed exclusive, and except as the Sub-Adviser may otherwise agree in writing, the Sub-Adviser shall be free to furnish similar services to others so long as its services under this Agreement are not impaired thereby.
