Service Date. (a) The Supplier will advise the Client of the date on which the Supplier will seek to commence provision of the Services (the “Estimated Service Date”). Except as expressly provided in the Additional Terms Schedule, the Supplier shall not be liable for any damages whatsoever resulting from any failure to meet the Estimated Service Date.
Service Date. The service date shall be the date the Customer connects to EH!tel services, or within 10 days of the date EH!tel has expired all attempts to schedule the installation of services, which ever comes first. (hereinafter called the “Service Date”).

Service Date. At such time as TCG completes installation or connection of the necessary fiber optic facilities and/or equipment to provide the Services, TCG shall conduct appropriate tests thereon. Such delays shall include, but not be limited to, delays in obtaining necessary regulatory approvals for construction, delays in obtaining right-of-way approvals and delays in actual construction work. In the event there is a Reseller or Customer caused delay, and such delay continues for thirty (30) days after the estimated service date for any Resale Services, TCG may commence billing Reseller for the Resale Services effective on such a date. TCG shall commence billing Reseller for the Resale Services effective on the Service Date and, if applicable, for costs of IntraLATA or InterLATA calls incurred by the Reseller subsequent to TCG notifying Reseller that such Services are available for use. For any Resale Services ordered by Reseller and provided by TCG, Reseller reserves the right to delay the Service Date, and provide TCG as much advance notice as reasonably possible, provided Reseller shall be liable to TCG for any applicable delay or change order charge assessed by the provider of the Resale Services.
Service Date. Supplier shall use commercially reasonable efforts to provide each Service ordered and accepted pursuant to a Firm Order Confirmation by no later than the date specified in or accepted by such Firm Order Confirmation. Supplier's standard provisioning intervals for Services are listed in the applicable Service schedule, and the scheduled Service Date specified in a Firm Order Confirmation shall in no event be prior to expiration of the applicable interval. Customer may request that such Service be made available prior to such specified date, in which event Supplier shall use reasonable efforts to make such Service available by the date requested, but Supplier shall not be responsible or in any way penalized or liable for its failure to do so. Customer may request that such Service be delayed by up to thirty (30) days after such specified date, as set forth in Attachment 2 under the caption "Billing and Payment." If Supplier fails to provide the Service by the date specified pursuant to the applicable Firm Order Confirmation and such failure is not due to (i) any FORCE MAJEURE Event, (ii) any failure of Customer to comply with the terms of this Agreement, or (iii) any fault or negligent act or omission of Customer, any End User or any other party, then Customer shall not be required to pay the Non-Recurring Charge with respect to such Service. Customer's relief from paying such Non-Recurring Charge shall be the sole and exclusive remedy of Customer in the event of such failure by Supplier to provide such Service by such date, and under no circumstances shall such failure be deemed a default under this Agreement.

Service Date. City and County acknowledge that the services provided under this contract are a continuation of those established during the preceding contract term and that these services may have been provided uninterruptedly between July 1, 2019 and the date of execution by the County in order to ensure the interest of public service.
