Seniority Applied Clause Samples
The "Seniority Applied" clause establishes the order of priority among different classes or tranches of obligations, rights, or claims within a contract. In practice, this clause determines which parties are paid first or have their claims satisfied before others, such as in the context of debt repayment where senior creditors are prioritized over junior creditors. By clearly defining the hierarchy of claims, the clause helps prevent disputes and ensures that all parties understand their position in the event of liquidation, default, or distribution of assets.
Seniority Applied. If seniority is to be used in the scheduling of vacation, request for time off must have been made at least three and one-half (3½) months in advance of the schedule. If a nurse(s) is denied vacation because more nurses request the same vacation time off than can be accommodated, that nurse(s) must notify their manager of their intention to apply their unit credit seniority within two (2) weeks of receiving their denial. A nurse who successfully uses the “seniority to be applied” may do so one (1) time every three (3) years regardless of whether the vacation time is taken. “Seniority to be applied” will be applied against the least senior nurse. Vacation requests will be responded to within two (2) weeks of application and will be granted in a manner consistent with the staffing needs. No request shall be unreasonably denied.

Seniority by location shall be the determining factor in the event of layoff and recall from layoff, reduction in hours, transfer, shift change, promotion, job openings, vacation scheduling, and additional straight-time hours of work, provided skill and ability are substantially equal. An employee who is to be laid off by seniority in a given classification shall have the right to assert seniority over employees in the same classification in another location or in another classification based on the employees skill and ability to perform the required work.
Seniority Applied. Seniority will be the determining factor for the purposes of preference on shift bids, overtime, layoff and recall, vacation, jobs, or vacancies providing the Employee is qualified.

Any employee moving from one (1) classification to another, from casual to part-time, part-time to full-time, shall be deemed to have served his/her probationary period and shall be entitled to the appropriate rate of pay for work performed.

Unit seniority, within job classifications, shall apply to the following: Layoff, recall from layoff, hour's reductions, shifts, holidays, vacations, overtime and to determine promotions when the qualifications oftwo candidates are equal. County seniority shall apply to benefit accruals.
