In case the Cardholders' data are collected and processed by the Merchant, this latter shall operate according to the provisions set forth by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data or by the applicable data protection laws in the country where the Merchant is established. The Merchant and shall store or transfer all media containing cardholder account information in a secured area, or as secured data, as defined in the applicable payment card industry.
