Common use of SECTION 913 Clause in Contracts

SECTION 913. 15 An employee on layoff status who rejects an offer of re-employment forfeits seniority and all other 16 accrued benefits; provided that such employee is offered a position substantially equal to that held 17 prior to layoff. Substantially is defined as at least 75% of hours worked prior to lay off.

SECTION 913. 15 9 An employee on layoff status who rejects an offer of re-employment forfeits seniority and all other 16 10 accrued benefits; provided that such employee is offered a position substantially equal to that held 17 11 prior to layoff. Substantially is defined as at least seventy-five percent (75% %) of hours worked prior to 12 lay off.
