Section 2. Time Limits. ‌ 28 Any time limits provided in this grievance procedure may be waived by 29 mutual written agreement of the parties. A failure by the Hospital to respond 30 within the time limits provided or agreed upon shall be deemed a rejection of 31 the grievance, and the grievance may be filed in the next step within the time 32 provided from the date of rejection. A grievance may be terminated at any 33 time upon receipt of a written statement from the Association that the matter 1 has been resolved; and a failure to submit or pursue the grievance in 2 accordance with this procedure or with the time limits prescribed or agreed 3 upon shall constitute an abandonment of the grievance.
Section 2. Time Limits. All time limits herein shall consist of school days, except that when a grievance is submitted by May 15th, time limits shall consist of all calendar days so that the matter may be resolved before the close of the school term. Such time limitations may be extended only by mutual consent. The initiation of a grievance must begin within 30 calendar days of the occurrence. Notice bearing a post mark of the U.S. The Postal System or an electronic time stamp will be considered as meeting the timeline provisions of this article.

Grievances will be processed as rapidly as possible; the number of days indicated at each step will be 16 considered as maximum, and every effort will be made to expedite the process, except that any 17 grievance will be processed during the period in which the parties involved are available. A grievant 18 must file a grievance within twenty (20) days of the alleged act or within twenty (20) days of the date of 19 knowledge of the act, whichever is later. 20 2. To the extent that time limits are expressed in days, days shall consist of school days except that after 21 the end of the regular school year they shall consist of all business days so that the grievance may be 22 adjusted as soon as possible. 23 3. Failure of either party to comply within the time limits set forth will serve to declare the grievance as 24 settled based upon the last request made or last answer provided, and no actions shall be taken. 25 4. The time limits as specified herein may be extended by mutual concurrence of the parties; provided 26 however, no request for extension of time limits shall be made by either party after the applicable time 27 limits in any of the grievance steps have already expired.

If a grievance is not appealed to the next step within the specified time 7 limit or any agreed extension thereof, it shall be considered settled on the basis of the Agency's or 8 designee's last answer. If the Agency or designee does not answer a grievance or an appeal thereof 9 within the specified time limits, the Council may elect to treat the grievance as denied at that step and 10 immediately appeal the grievance to the next step. The time limit in each step may be extended by 11 mutual written agreement of the Agency or designee and the Council at each step. The parties may 12 waive Steps 1 and/or 2 by mutual written agreement of the Agency or designee and the Council.

  • Time Limits Each party involved in a grievance shall act quickly so that the grievance may be resolved promptly. Every effort should be made to complete action within the time limits contained in the grievance procedure. However, with the mutual consent of the parties, the time limitation for any step may be extended.

  • Time Limit Should the Local Church fail to satisfy all of its obligations set forth herein by December 31, 2023, this Disaffiliation Agreement shall be null and void.

  • Extension of Time Limits The time limits referred to in this Article may be extended by mutual agreement of the parties in writing.

  • Time Limitation The time limits established in the grievance procedures shall be followed by the parties and the aggrieved employee. If the time limit procedure is not followed by the Union or the aggrieved employee, the grievance shall be considered settled without precedent. If the time procedure is not followed by the Employer, the grievance shall automatically advance to the next step, but arbitration shall only be instituted upon timely written notice by the Union. The time limits established in the grievance and arbitration procedure may be extended by mutual agreement reduced to writing and signed by the parties.

  • Amending Time Limits The time limits fixed in the arbitration procedure may be altered by mutual consent of the parties but the same must be in writing.
