Second Meal Clause Samples
The "Second Meal" clause establishes the conditions under which an employee is entitled to a second meal break during their work shift. Typically, this clause applies when an employee works beyond a certain number of hours, such as more than ten hours in a single day, and outlines whether the second meal period can be waived or must be provided. Its core practical function is to ensure compliance with labor regulations regarding employee rest periods, thereby protecting worker health and reducing employer liability for meal break violations.
Second Meal. A. Train Crews will be afforded the opportunity for a second meal provided that they have been on duty at least 9 hours. The time for fixing the beginning of assignments for the purpose of a second meal is to be calculated from the time fixed for the crew to begin work as a unit without regard to preparatory or individual duties.
B. Train Crews desiring a second meal must provide the supervisory employee with sufficient advance notice; in no case less than one hour. The supervisory employee may instruct the crew to take the opportunity for a second meal prior to the expiration of 9 hours in instances where the train is delayed or is subject to delay. Crews declining such opportunity will be deemed to have foregone the entitlement to a second meal during their tour of duty.
C. Train Crews who, pursuant to Article 2.21, have utilized an eating facility at the initial terminal or were afforded the opportunity to do so, will not be permitted stop, on the basis that they will have retained the food intended for consumption on the road. Thus, any second meal during the tour of duty will become their first meal on the road and will be taken in accordance with the provisions of Article 2.21(c).
D. All members of the train and engine crew will take the opportunity for a second as a unit with the minimum time necessary to obtain the meal Train and engine crews deadheading will take the opportunity for a meal as a unit at the same time as the working crew.
E. If over 40 minutes is taken to obtain a second meal, all time over 40 minutes shall be excluded from the 10 hours or more on duty, or the 11 hours or more on duty, as the case may be, in the application of Article 26..
Second Meal. Employees shall receive a twelve-dollar ($12) allowance when they take a second meal break of at least thirty (30) minutes or if that meal period is cancelled at the supervisor’s request.
Second Meal. A second meal period not less than one (1) hour's duration shall be assigned in tours of of more than ten (10) hours, during which a first meal period was assigned. This second meal period shall be assigned within the fourth (4th) or fifth (5th) hour after completion of the first meal period. Six Dollars($6.00) shall be paid to compensate for the of this second meal.
Second Meal. Employees who must work more than ten (10) hours within a single shift must be given an allowance of twelve dollars (12$) in compensation for the cost of a second meal. They shall also, on request and insofar as operational needs allow it, benefit from a second unpaid meal break that shall last at least thirty (30) but no more than sixty (60) minutes.
