Common use of Scope of Attachment Clause in Contracts

Scope of Attachment. 1.1 The rates, terms, and conditions contained within this Attachment shall only apply when TelCove is collocated as a sole occupant or as a Host within a BellSouth premises location pursuant to this Attachment. BellSouth premises include BellSouth Central Offices and Serving Wire Centers; all buildings or similar structures owned, leased, or otherwise controlled by BellSouth that house its network facilities; all structures that house BellSouth facilities on public rights-of-ways, including but not limited to vaults containing loop concentrators or similar structures; and all land owned, leased, or otherwise controlled by BellSouth that is adjacent to BellSouth’s Central Offices, Serving Wire Centers, buildings and structures (hereinafter “Premises”). BellSouth Remote Site Locations (Remote Site Locations) include cabinets, huts and controlled environmental vaults owned or leased by BellSouth that house BellSouth Network Facilities. If the Premises occupied by BellSouth is leased by BellSouth from a third party or otherwise controlled by a third party, special considerations and/or intervals may apply in addition to the terms and conditions contained in this Attachment. BellSouth will inform TelCove if a Premises is leased when special considerations and/or intervals may be applicable. 1.2 If BellSouth provides collocation to other telecommunications carriers, or to a BellSouth Affiliate, BellSouth will provide the same collocation to TelCove at rates, terms and conditions no less favorable to TelCove than those provided by BellSouth to other telecommunications carriers, or to a BellSouth Affiliate.
