Common use of Schematic Drawings Clause in Contracts

Schematic Drawings. If the Schematic Drawings depicting the layout of the Premises and the location of the Lessee Improvements therein (the “Schematic Drawings”) have already been prepared and approved by Lessor and Lessee prior to the full execution of this Lease (which includes this Agreement), then same shall be attached hereto as Exhibit “C-5”) and made a part hereof. If the Schematic Drawings are not attached as Exhibit “C-5” hereto at the time this Lease is fully executed, then the following procedure shall be used to prepare and approve of the Schematic Drawings. No later than five (5) days following the full execution of this Lease, Lessee shall meet with the Architect and provide such information as is necessary or appropriate for the Architect to prepare the Schematic Drawings. Such Schematic Drawings, upon completion thereof (which in no event shall be more than thirty (30) days after the execution of this Lease), shall be submitted to Lessor and Lessee for approval. Within five (5) days after Lessee’s receipt of such Schematic Drawings, Lessee shall notify Lessor and Architect of the changes, if any, which Lessee desires to make to such Schematic Drawings, which notice shall be in writing and shall identify with specificity the changes which Lessee desires to make and shall attach a copy of the Schematic Drawings initialed by Lessee and showing the desired changes EXHIBIT “C” (the “Lessee’s Schematic Notice”). Within a reasonable time following Lessor’s receipt of the Schematic Drawings and Lessee’s Schematic Notice (but Lessor shall not be obligated to respond earlier than five (5) days after Lessor’s receipt of the Schematic Drawings and Lessee’s Schematic Notice), Lessor shall either approve or disapprove thereof. If Lessor disapproves, Lessor shall specify in writing the changes which Lessor requires and the Schematic Drawings shall be revised by the Architect to reflect those changes described in Lessee’s Schematic Notice which are not disapproved by Lessor and such other items needed to satisfy Lessor’s objections thereto. At Lessor’s request, upon completion of the revised Schematic Drawings, Lessor and Lessee shall initial same, thereby acknowledging their approval of the form of such Schematic Drawings.

Such Schematic Drawings, upon completion thereof (which in no event shall be more than thirty (30) days after the execution of this Lease)thereof, shall be submitted to Lessor and Lessee for approval. Within five ten (510) days after Lessee’s receipt of such Schematic Drawings, Lessee shall notify Lessor and Architect of the changes, if any, which Lessee desires to make to such Schematic Drawings, which notice shall be in writing and shall identify with specificity the changes which Lessee desires to make and shall attach a copy of the Schematic Drawings initialed by Lessee and showing the desired changes EXHIBIT “C” (the “Lessee’s Schematic Notice”). Within a reasonable time following Lessor’s receipt of the Schematic Drawings and Lessee’s Schematic Notice (but Lessor shall not be obligated to respond earlier than five (5) days nor later than ten (10) days after Lessor’s receipt of the Schematic Drawings and Lessee’s Schematic Notice), Lessor shall either approve or disapprove thereofthereof (which disapproval shall be limited to a Design Problem), by written notice which shall identify with specificity the Design Problems as noted by Lessor (“Lessor’s Schematic Notice”). If Lessor disapproves, Lessor shall specify in writing the changes which Lessor requires and the The Schematic Drawings shall be revised by the Architect to reflect those changes described in Lessee’s Schematic Notice which are not disapproved by Lessor and such other those items needed to satisfy set forth in Lessor’s objections theretoSchematic Notice. In such event, the Architect shall revise the Schematic Drawings and return them to Lessee and Lessor, which Lessor and Lessee shall approve or disapprove within three (3) days after receipt of same. This procedure shall be repeated until the Schematic Drawings are finally approved by Lessor and Lessee. The Schematic Drawings may be submitted by Lessee in one or more stages and at one or more times and Lessor’s approval shall apply with respect to each such portion submitted. At Lessor’s request, upon completion of the revised Schematic Drawings, Lessor and Lessee shall initial same, thereby acknowledging their approval of the form of such Schematic Drawings.

No later than five three business (53) days following the full execution of this Lease, Lessee shall meet with the Architect and provide Continental Development Corporation and determine such information as is necessary or appropriate for the Architect to prepare the Schematic DrawingsDrawings and other information necessary for each party to insure satisfactory compliance with all aspects of this Agreement. Such information shall include, but not be limited to, building standard unit costs, basic core and shell systems performance criteria and above standard components. This information is to be provided within eight (8) business days of the date of execution. Such Schematic Drawings, upon completion thereof (which in no event shall be more than thirty thirteen (3013) business days after the execution of this Lease), shall be submitted to Lessor and Lessee for approval. Within five (5) days after Lessee’s 's receipt of such Schematic Drawings, Lessee shall notify Lessor and Architect of the changes, if any, which Lessee desires to make to such Schematic Drawings, which notice shall be in writing and shall identify with specificity the changes which Lessee desires to make and shall attach a copy of the Schematic Drawings initialed by Lessee and showing the desired changes EXHIBIT “C” (the “"Lessee’s 's Schematic Notice”").
