Common use of Schematic Design Phase Clause in Contracts

Schematic Design Phase. a. The ARCHITECT shall review the program furnished by the DISTRICT to ascertain the requirements of the PROJECT and shall review the understanding of such requirements with the DISTRICT. b. The ARCHITECT shall prepare, for approval by the DISTRICT, Schematic Design Documents consisting of drawings and other documents illustrating the scale and relationship of PROJECT components, codes, rules and regulations which are applicable to these documents. The ARCHITECT shall prepare the Schematic Design Documents to comply with the requirements of all governmental agencies having jurisdiction over the PROJECT including, but not limited to, the Division of State Architect (DSA) and the local Fire Department. c. The ARCHITECT shall prepare schematic design studies and site utilization plans leading to a recommended solution together with a general description of the PROJECT for approval by the DISTRICT. d. If directed by the DISTRICT at the time of approval of the schematic design, the Construction Documents shall be prepared so that portions of the work of the PROJECT may be performed under separate construction contracts, or so that the construction of certain buildings, facilities, or other portions of the PROJECT may be deferred. Alternate construction schemes made by the DISTRICT subsequent to the Schematic Design Phase shall be provided as an additional service pursuant to Article III unless the alternate construction scheme arises out of the PROJECT exceeding the estimated Budget constraint as a result of the ARCHITECT’s services under this agreement. e. ARCHITECT shall submit a list of qualified engineers for the PROJECT for the DISTRICT’s approval in conformance with Article XII. ARCHITECT shall ensure that each engineer places his or her name, seal and signature on all drawings and specifications prepared by said engineer. f. The ARCHITECT shall investigate existing conditions or facilities and verify drawings of such conditions or facilities. g. The ARCHITECT shall perform Schematic Design Services to keep the PROJECT within all Budget and scope constraints set by the DISTRICT, unless otherwise modified by written authorization by the DISTRICT. h. The ARCHITECT shall submit to the DISTRICT a written estimate of the construction cost to reflect actual plan scope at the conclusion of each development phase, in conformance with Articles V and VI and shall advise the DISTRICT, in writing, of any adjustments to the estimate of Construction Cost.

Schematic Design Phase. a. This graphic documentation of the DISTRICT, design criteria shall be updated with each subsequent submittal. 2.2.5 Design Professional shall prepare Schematic Design Documents consisting of drawings studies consistent with and incorporating the Project Program requirements, including site plans, floor plans, elevations, sections, and other documents illustrating drawings, sketches, or graphic materials needed to describe the scale Project (and relationship of PROJECT componentsDesign Packages, codesif required by University) in three dimensions. Design Professional shall also prepare descriptive outline specifications indicating proposed architectural, rules structural, mechanical, and regulations which are applicable to these documentselectrical systems and materials and other systems as described in Supplemental Requirements (Exhibit C). The ARCHITECT Schematic studies shall prepare be consistent with the construction budget, Project Schedule and Design Packages, if required by University and shall be revised until approved by University as acceptable. Schematic Design Documents to comply with the requirements of all governmental agencies having jurisdiction over the PROJECT including, but not limited to, the Division of State Architect (DSA) and the local Fire Department. c. ARCHITECT 2.2.6 Design Professional shall submit a list tabulation comparing both gross and assignable floor areas to the initial Project Program area requirements, as required by Exhibit C. 2.2.7 Design Professional shall submit a written Estimated Project Construction Cost based on the documents submitted in this phase. The estimate shall be in the form included in Exhibit C. Design Professional shall submit a written Estimated Phase Construction Cost for each separate portion of qualified engineers the Project for the PROJECT for the DISTRICT’s approval in conformance with Article XII. ARCHITECT shall ensure that each engineer places his or her name, seal and signature on all drawings and specifications prepared by said engineer. f. Upon written direction, Design Professional shall prepare a design presentation for The Regents in accordance with the Project Schedule provided by University. Schematic Design Phase. a. The ARCHITECT shall prepare schematic design studies and site utilization plans leading to a recommended solution together with a general description specific task responsibilities of the PROJECT Architect, required completion times necessary for the review and approval by the DISTRICTDistrict and by pertinent regulatory agencies and additional definition of deliverables. Architect shall review the developed work plan with the District representatives to familiarize them with the proposed tasks and schedule and develop necessary modifications. The Construction Manager shall be responsible to establish overall project milestones in which the Architect shall adjust its timelines and manpower as appropriate. d. 2. Architect shall present and review with the District the detailed Schematic Design. The Schematic Design shall be revised until a final concept within the approved Construction Budget has been accepted and approved by the District at no additional cost to the District. ARCHITECT shall ensure that each engineer places his major equipment or her name, seal and signature on all drawings and specifications prepared by said engineeroperational layout. f. The ARCHITECT shall investigate existing conditions or facilities ii. Preliminary exterior elevations and verify drawings sections in sufficient detail to demonstrate design concept indicating location and size of such conditions or facilitiesfenestration. g. The ARCHITECT shall submit to the DISTRICT a written estimate of the construction cost to reflect actual plan scope at the conclusion of each development phase, in conformance with Articles V and VI and shall advise the DISTRICT, in writing, of any adjustments to the estimate of Construction Cost. i. The ARCHITECT shall not proceed to do any work or perform any services for the Design Development Phase without first obtaining written approval from the DISTRICT of the Schematic Design Documents and Information.

The ARCHITECT shall prepare schematic design studies and site utilization plans leading to a recommended solution together with a general Contract Documents, including the description of the PROJECT for approval RFP Documents, specifically Appendix 2 and the School Design Guide furnished by the DISTRICTDistrict. d. If directed by 6.3.2 Design−Builder shall prepare Schematic Design Documents consistent with and incorporating the DISTRICT at the time Division 1 Specifications and Scope of approval Work identified in Appendix 2 of the schematic RFP Documents. These documents shall include site plans, floor plans, elevations, sections, and other drawings, sketches or graphic materials needed to describe the Project in three dimensions as well as descriptions of the relationship of the project to on−and off−site improvements. Design−Builder shall also prepare descriptive outline specifications indicating proposed architectural, structural, mechanical and electrical systems and materials and other systems. The Schematic Design submittal shall be in accordance with the School Design Guidelines. 6.3.3 The Design−Builder shall, as required to inform the design process and at a minimum one (1) time during the Schematic Design Phase, conduct site visit(s) with the District’s Authorized Representative to observe and verify existing conditions and validate the proposed design. 6.3.4 During the Schematic Design services, the Construction Documents Design−Builder, through its Architect of Record, shall conduct a Sustainability workshop with the District’s project team, the Architect of Record’s consultants, and any other necessary representative of the Design−Builder, and District’s Sustainability Specialist, during which the participants will review and discuss potential options for the Sustainability Plan for Sustainability Certification(s); establish the Sustainability Objectives; discuss potential Sustainability Measures to be targeted; examine strategies for implementation of the Sustainability Measures; which parties shall be prepared so that portions responsible for the completion of required tasks and attainment of each Sustainability Measure and discuss the potential impact of the work measures to the project schedule and to the District’s program and budget. 6.3.5 Following the sustainability workshop, the Design−Builder shall prepare a Sustainability Plan based on the Sustainability Objective and targeted Sustainability Measures. The Design−Builder shall provide to the District copies of project specific CHPS scorecard along with the Sustainability Plans part of the PROJECT may be performed under separate construction contracts, or so that the construction of certain buildings, facilities, or other portions 100% Schematic Design Submittal. The Sustainability Plan and related materials are subject to District approval. 6.3.6 As a part of the PROJECT may be deferred100% Schematic Design submittal, the Design−Builder shall also furnish the District with documentation as required in the School Design Guidelines. Alternate construction schemes made by the DISTRICT subsequent to The Design−Builder shall complete works and services required under the Schematic Design Phase shall be provided as an additional service pursuant of this Agreement, and submit such works to Article III unless the alternate construction scheme arises out of District for their approval in accordance with the PROJECT exceeding the estimated Budget constraint as a result of the ARCHITECT’s services under this agreementProject Schedule. e. The Virtual Tour shall include music and contain animation that is generally accepted to be of good quality to convey the spatial, material and natural lighting qualities of the project. The Virtual Tour experience shall include surrounding existing context where necessary to understand the relationship of new buildings with Articles V existing buildings and VI and site features. Specialty interior spaces (i.e., gymnasiums, science labs, performing arts spaces, etc.) shall advise be showcased as fully rendered (2D or 3D). Resolution of the DISTRICT, in writing, of any adjustments to the estimate of Construction Costfinal animation shall be at least full HD (1920x1080 DPI).

If directed by the DISTRICT at the time of approval of the schematic design, the Construction Documents project’s documents shall be prepared so that portions of the work of the PROJECT may be performed under separate construction contracts, or so that the construction of certain buildings, facilities, or other portions of the PROJECT may be deferred. The ARCHITECT shall submit to the DISTRICT a written estimate of the construction cost to reflect actual plan scope at the conclusion of each development phase, in conformance with Articles V and VI and shall advise the DISTRICT, in writing, of any adjustments to the estimate of Construction Cost. i. The ARCHITECT shall not proceed to do any work or perform any services for the Design Development Phase without first obtaining written approval from the DISTRICT of the Schematic Design Documents and Information.

The ARCHITECT shall prepare schematic design studies and site utilization plans leading to a recommended solution together with a general description of fire marshal/department, which are required for the PROJECT for approval by the DISTRICT. d. If directed by the DISTRICT at the time of final approval of the schematic design, the Project’s completed Construction Documents shall be prepared so that portions of the work of the PROJECT may be performed under separate construction contracts, or so that the construction of certain buildings, facilities, or other portions of the PROJECT may be deferredDocuments. Schematic Design Phase. a. The ARCHITECT 7.4.1 Upon receipt of an Approval to proceed to Schematic Design Phase, the Designer shall review meet with the program furnished by the DISTRICT Owner to ascertain arrive at a mutual understanding of the requirements of the PROJECT Final Design Program approved in writing by the Owner and the Authority. 7.4.2 The Designer shall submit a proposed design work plan pursuant to this Contract including anticipated tasks and submittals. The Designer shall also submit to the Owner a proposed schedule consistent with any Project Schedule included in the RFS (Attachment B) modified as required by any subsequent schedule changes or delays outside of Designer’s control. The schedule shall contain dates for submittals, deliverables, actions, milestones, design workshops, meetings and the critical path through all design service activities. It shall include time for the Owner's and the Authority's review and approval of submittals and for necessary submissions for permits in connection with the Project. The work plan shall also include a work plan schedule of values consistent with Attachment A, which shall be the basis for which payments of the Fee for Basic Services within each Phase shall be made. The work plan schedule of values shall identify deliverables within each Phase and percentages of the phase fee payable upon completion of such deliverable. When approved by the Owner as provided in Article 7.4.8, the work plan schedule of values shall govern the timing of payments of the Fee for Basic Services upon completion of deliverables within each Phase and as each Phase progresses. 7.4.3 The Designer shall: Prepare a preliminary evaluation of the Recommended Preferred Solution from the Feasibility Study, the Final Design Program, and Proposed Total Project Budget; collect and study all available drawings, reports, maintenance reports, and other existing data pertaining to the Project; conduct a thorough on-site review of conditions relating to the Project; assure that the “Recommended Preferred Solution” complies with all applicable codes and regulations, including any special design standards supplied by the Authority and its Commissioning Consultant; and meet with local building officials to identify and confirm applicable standards, codes and any project specific criteria. 7.4.4 The Designer shall develop the Recommended Preferred Solution to a full schematic design level. Schematic design level documentation shall be based on the Final Design Program, shall incorporate Owner and Authority comments and shall review include each of the understanding following, to the extent applicable to the Recommended Preferred Solution: (a) Traffic Analysis - analyze the impact of such anticipated vehicular and pedestrian traffic, including impacts to existing infrastructure, to determine efficient and safe site access. (b) Environmental and Existing Building Assessment – Provide additional site and building assessments as may be required to quantify presence of unsuitable materials and scope of possible remediation efforts. (c) Geotechnical and Geoenvironmenta l Analysis – Provide additional geotechnical analysis as may be required to describe soil conditions, remediation requirements and appropriate foundation. (d) Program Analysis - a space measurement analysis for the design which shall verify that the sum of all program floor areas plus all other floor areas equal the gross floor area of the Final Design Program. (e) Code Analysis – Determine the impact of all applicable federal, state, regional and local codes, regulations and ordinances, including a listing of permitting and other regulatory filing requirements. (f) Utility Analysis – Determine the availability and capacity of all required building utilities. Provide soils analysis and preliminary design for on-site septic/sewage treatment facilities, if required. (g) Massing Study – an analysis of the building’s integration into its surroundings and neighborhood with drawings, models, or photographs. (h) MA-CHPS or LEED-S Scorecard – Pursuant to the Authority’s Sustainable Building Design Guidelines complete a MA-CHPS or LEED-S for Schools Scorecard and describe sustainable design features and each high performance green school prerequisite and credit included in the proposed design and a plan for implementation or inclusion of any appropriate public utility energy conservation design programs. (i) Accessibility - an analysis of the design's compliance with the DISTRICT. b. The ARCHITECT shall prepare, for approval by the DISTRICT, Schematic Design Documents consisting of drawings and other documents illustrating the scale and relationship of PROJECT components, codes, rules and regulations which are applicable to these documents. The ARCHITECT shall prepare the Schematic Design Documents to comply Americans with the requirements of all governmental agencies having jurisdiction over the PROJECT including, but not limited to, the Division of State Architect Disabilities Act (DSAADA) and the local Fire DepartmentMassachusetts Architectural Access Board requirements (MAAB). c. The ARCHITECT shall prepare schematic design studies and site utilization plans leading to a recommended solution together with a general description of the PROJECT for approval by the DISTRICT. d. If directed by the DISTRICT at the time of approval of the schematic design, the Construction Documents shall be prepared so that portions of the work of the PROJECT may be performed under separate construction contracts, or so that the construction of certain buildings, facilities, or other portions of the PROJECT may be deferred. The work plan schedule of values shall identify deliverables within each Phase and percentages of the phase fee payable upon completion of such deliverable. (b) Site Development Plan – Site plan shall be at a minimum scale of 1 inch equals 40 feet and include property lines with bearings and distances, building setbacks, site acreage, wetlands information, proposed and existing topography, proposed and existing buildings and site features, floor and roof elevations for all buildings, proposed and existing utilities and utility connections, emergency equipment access. (c) Traffic Analysis - analyze the impact of anticipated vehicular and pedestrian traffic, including impacts to existing infrastructure, to determine efficient and safe site access. (d) Environmental Assessment – Provide additional site and building assessments as may be required by the Authority to quantify presence of unsuitable materials and scope of possible remediation efforts. (e) Geotechnical and Geoenvironmental Analysis – Provide additional geotechnical analysis as may be required by the Owner or the Authority to describe soil conditions, remediation requirements and appropriate foundation. (j) Schematic Building Floor Plans of all floors and roof at a minimum scale of 1/16” =1’-0” showing all elements of the building including overall dimensions, gross square footage of each floor and net square footage of each space, response to functional requirements of program, major and minor access, and circulation. (k) Schematic Exterior Building Elevations for all sides and orientations indicating all exterior finishes and fenestration. (l) Building Systems Descriptions – Describe in narrative and on schematic plans basic information relative to: 1. Building Structure - a written narrative of the design approach to the structural systems including discussion of the feasible options for foundations and superstructure as well as treatment of special situations such as unusual soils conditions or long spans. 2. Plumbing and HVAC - written narratives of the basic systems and proposed fuel source(s) and a preliminary life cycle cost analysis pursuant to Article III unless the alternate construction scheme arises out criteria of M.G.L. c. 149 § 44(m). Provide schematic plans indicating basic distribution concepts and the PROJECT exceeding the estimated Budget constraint location of major equipment items such as a result of the ARCHITECT’s services under this agreementboilers, water heaters, cooling towers, chillers, air handling units, heat recovery units, exhaust stacks, special systems (e.g. fume exhausts). e. ARCHITECT shall submit a list of qualified engineers for the PROJECT for the DISTRICT’s approval in conformance with Article XII. (c) Schematic design will include the normal and regulations which are applicable to these documentscustomary disciplines for the standard of care in designing a (insert type of facility) of this size including, (architectural design, structural design, mechanical design, electrical design, civil design, landscape design, and interior design – modify as required for the project). The ARCHITECT will include materials research and specifications in this phase of the Project. (d) (CONSTRUCTION MANAGER) will provide COUNTY with a schematic design statement of probable construction cost. Should the (CONSTRUCTION MANAGER’S) statement of probable construction cost exceed the Project budget, the ARCHITECT shall prepare the Schematic Design Documents to comply work with the requirements of all governmental agencies having jurisdiction over the PROJECT including, but not limited to, the Division of State Architect (DSA) COUNTY and the local Fire Department. c. The (CONSTRUCTION MANAGER) to make changes to bring the Project within the budget, and the ARCHITECT shall prepare schematic design studies and site utilization plans leading to a recommended solution together will present the COUNTY with a general description of the PROJECT for approval by the DISTRICT. d. If directed by the DISTRICT appropriate cost reduction options at the time of approval completion of the schematic designdesign phase. ARCHITECT will be entitled to rely upon the accuracy of the (CONSTRUCTION MANAGER’S) statement of probable construction cost. (modify paragraph as required for project) (e) ARCHITECT and (CONSTRUCTION MANAGER) will make recommendations to the COUNTY where a conflict may exist between the established budget and the schematic design cost estimate. Said recommendations (accepted by the COUNTY) will provide for adjustments to enable construction of the facility within the budget and during the forecast period that the project will be bid. Schematic Design Phase. a. The ARCHITECT 2.2.1 Upon written authorization to proceed, Design Professional shall review evaluate the program furnished by the DISTRICT Project Program (Exhibit H) to ascertain the requirements of the PROJECT Project and shall review and 2.2.2 Design Professional shall provide a written preliminary evaluation of the understanding Project program and the Construction Budget requirements each in terms of such requirements the other. 2.2.3 Design Professional shall prepare and submit to University an outline of applicable provisions of building codes which apply to this Project. The outline shall include a written report and diagrammatic drawings which delineate the design criteria (e.g., exit paths, travel distances, required exits, rated walls, rated corridors, building occupancy, construction type, and fire zones). This graphic documentation of the design criteria shall be updated with each subsequent submittal. 2.2.5 Design Professional shall prepare Schematic Design studies consistent with and incorporating the Project Program requirements, including site plans, floor plans, elevations, sections, and other drawings, sketches, or graphic materials needed to describe the Project (and Design Packages, if required by University) in three dimensions. Design Professional shall also prepare descriptive outline specifications indicating proposed architectural, structural, mechanical, and electrical systems and materials and other systems as described in Supplemental Requirements (Exhibit C). Schematic studies shall be consistent with the DISTRICT. b. The ARCHITECT construction budget, Project Schedule and Design Packages, if required by University and shall prepare, for approval be revised until approved by the DISTRICT, University as acceptable. Schematic Design Documents consisting of drawings and other documents illustrating the scale and relationship of PROJECT components, codes, rules and regulations which are applicable to these documents. The ARCHITECT shall prepare the Schematic Design Documents to comply with the requirements of all governmental agencies having jurisdiction over the PROJECT including, but not limited to, the Division of State Architect (DSA) and the local Fire Department. c. The ARCHITECT shall prepare schematic design studies and site utilization plans leading to a recommended solution together with a general description of the PROJECT for approval by the DISTRICT. d. ARCHITECT 2.2.6 Design Professional shall submit a list tabulation comparing both gross and assignable floor areas to the initial Project Program area requirements, as required by Exhibit C. 2.2.7 Design Professional shall submit a written Estimated Project Construction Cost based on the documents submitted in this phase. The estimate shall be in the form included in Exhibit C. Design Professional shall submit a written Estimated Phase Construction Cost for each separate portion of qualified engineers the Project for the PROJECT for the DISTRICT’s approval in conformance with Article XII. ARCHITECT shall ensure that each engineer places his or her name, seal and signature on all drawings and specifications prepared by said engineer. f. The ARCHITECT shall investigate existing conditions or facilities and verify drawings of such conditions or facilities. g. The ARCHITECT shall perform which Design Professional submits a Schematic Design Services to keep the PROJECT within all Budget and scope constraints set by the DISTRICT, unless otherwise modified by written authorization by the DISTRICTStudy. h.
