Safety Standard Changes. ODM shall promptly notify EMACHINES if any ----------------------- upgrade, substitution or other change to any ODM Component or Third Party Component is required to make the Component meet applicable safety standards or other governmental statutes, rules, orders or regulations. If an ODM Component or Third Party Component meets applicable safety standards and other governmental requirements at the time of manufacture, EMACHINES and ODM will allocate the costs of any subsequent upgrade, substitution or other required change in an equitable manner based on good faith discussions between the Parties.
