Royalty Not Affected by Invalidity of Royalty Deeds. Neither --------------------------------------------------- the declaration or claim by any Person or the decision of any court that one or more Royalty Deeds is invalid or unenforceable, in whole or in part, nor the pendency of any Proceeding with respect to any such claim, shall render unenforceable the Royalty payable by Purchaser hereunder, and Purchaser agrees that it shall continue to be bound by and comply with the provisions of this Section 5.10 in the event of any such declaration or decision.

  • Severability and Modification of Any Unenforceable Covenant It is the parties’ intent that each of the Covenants be read and interpreted with every reasonable inference given to its enforceability. However, without limiting the generality of Section 5.5 herewith, it is also the parties’ intent that if any term, provision or condition of the Covenants is held to be invalid, void or unenforceable, the remainder of the provisions thereof shall remain in full force and effect and shall in no way be affected, impaired or invalidated.
