Rough-Grading. Buyer understands that, although rough grading of the Property to create level pads has been completed, such work was performed by Seller's predecessor-in-interest. Seller has not performed any grading or any construction of improvements on the Property. Seller has provided Buyer with a Certificate from Rick ▇▇▇ineering certifying that the Property has been graded in conformance with the approved Grading Plans, as described in Section 5.1(1), which work was completed prior to Seller's acquisition of the Property. Seller makes no representations or warranties as to the quality of the soils present on the Property. Except for Seller's Improvements described in Section 7.2, Seller has no obligation to perform any further work or to construct any improvements to the Property. If a grading defect is discovered on the Property after Closing, Seller shall, upon Buyer's request, assign to Buyer any cause of action which Seller may possess with respect to the Property against any contractors who may be liable for the defect.
Rough-Grading. It shall not be a violation of this Agreement if Employees covered by this Agreement refuse to work on a job, particularly a residential job, where the area adjacent to a building, has not been rough-graded.
Rough-Grading. This item shall be carried out in accordance with the Department's Standard Specification, Division 2 Section 10 – Rough Grading except as modified below. This item shall be for rough grading the abandoned roadway surfaces after gravel removal to prepare the surface to be hydroseeded.
Rough-Grading. Seller warrants that compaction will be appropriate ------------- for construction of a two-story building for stated use. The cost of any compaction tests will be borne by Purchaser.
Rough-Grading. A. Rough grading shall include the shaping, trimming, rolling, and refinishing of all surfaces of the subbase and base courses, shoulders, and earth slopes in preparation for final, finish grading of pavements, loams and site improvements as shown on the Contract Drawings. The rough grading of shoulders and sloped areas may be done by machine methods. All ruts shall be eliminated. Traffic of men and equipment across soil subgrade areas shall be prohibited following excavation to the required lines and grades.
1. Shape subbase and base courses to required crown elevations and cross-slope grades.
2. When thickness of compacted subbase or base course is 6 inches or less, place materials in a single layer.
3. When thickness of compacted subbase or base course exceeds 6 inches, place materials in equal layers, with no layer more than 6 inches thick or less than 3 inches thick when compacted.
B. If, during the progress of the Work, any pipe, drain or other construction is damaged due to operations under this Contract, the Contractor shall repair all damage at no additional cost to the Owner and restore damaged areas to their original conditions.
C. Do all other cutting, filling and grading to the lines and grades indicated on the Drawings. Grade evenly to within the dimensions required for grades shown in the Contract Documents and as specified herein. No stones larger than 3 inches in largest dimension shall be placed in upper 6 inches of the subgrade. Fill shall be left in a compacted state at the end of the workday and sloped to drain.
D. Slope grades to direct water away from buildings and to prevent ponding. Rough grade to required elevations within the following tolerances:
1. Turf or Unpaved Areas: Plus/minus 0.10 foot.
2. Paved Areas: Plus/minus 0.05 foot.
