Common use of Review of Contract Clause in Contracts

Review of Contract. The Vendor has examined in detail and carefully studied and compared the Contract with all other information furnished by the Owner and has promptly reported to the Owner any material errors, inconsistencies or omissions so discovered or discovered by any of the Subcontractors. The Vendor will not prosecute any Major Portion of the Work knowing that it involves a material error, inconsistency or omission in the Contract without prior written notice to and approval by the Owner. If for any reason the Vendor violates this subsection 2.28, the Vendor will, in addition to being subject to any other remedies of the Owner, assume responsibility for such violation and, in such case, will be deemed to have waived any claims for an adjustment in any of the Specifications and/or System Standards which results directly from any such error, inconsistency or omission. This subsection 2.28 does not, nor will be deemed to, in any manner limit the terms of subsection 2.39.
