Common use of Retailer Status Clause in Contracts

Retailer Status. 2.1 A Contract, not a License: This Contract constitutes an agreement between the Parties and is not a license issued by Lottery as a regulatory body. Retailer acknowledges and agrees that it does not have the same legal rights, such as the right to a contested case hearing, that it would have under a license with a licensing body such as the Oregon Liquor Control Commission (OLCC). Retailer waives any claim or right to an administrative hearing before Lottery with regard to any issues related to or arising under this Contract. Neither Party is obligated to sign this Contract, and it has no force or effect unless and until the Director or the Director’s designee, and Retailer have signed it.
