Restriction Requests on Uses and Disclosures. Business Associate shall not agree to a restriction on the Use or Disclosure of Protected Information pursuant to 45 CFR § 164.522(a) or Section 13405(a) of the HITECH Act without first consulting CenturyLink. Business Associate is not obligated to implement any restriction, if such restriction would hinder Health Care Operations or the Services Business Associate provides to CenturyLink or Covered Entity, unless such restriction would otherwise be required by Section 13405(a) of the HITECH Act.
