Common use of Responsibility for Emergencies Clause in Contracts

Responsibility for Emergencies. When emergencies affecting or threatening the safety of any person or property occur, the Contractor shall immediately act with diligence to prevent injury to such person, or damage or loss to such property. If the Contractor should fail to act, the Owner may, but is not obligated to, act immediately to prevent injury to such person, or damage or loss to property, whichever may be endangered by the emergency by whatever means or method the Owner deems appropriate, including, but not limited to, the use of other contractors, the Owner's own forces, and the Contractor's on-site equipment and materials, in which case, the Contractor shall pay the Owner for any such expenses incurred as provided in Section 10.05 (Owner's Right to Carry out the Work).
