Response to Request. Upon the request for assistance from a Requesting Party, the Responding Official may authorize and direct his/her party’s personnel to provide assistance to the Requesting Party. This decision will be made after considering the needs of the Responding Party and the availability of resources. The decision of the Responding Party or Official to respond shall be determined solely by the Responding Official and shall be conclusive. No liability to the Responding Party or Official shall result by failing to respond or provide assistance to the Requesting Party.

Response to Request. Upon receipt of a request the Responding Agency will determine if the Responding Agency has equipment and personnel available to respond to the request of the Requesting Agency and determine the type of the equipment and number of personnel available. In the event the requested equipment and/or personnel are not available, then the Responding Agency shall immediately advise the Requesting Agency that assistance cannot be provided.
Response to Request. The party requested to provide assistance should respond to the request as soon as possible, indicate whether services will be provided, and if so, the extent of services that can be provided. If the responding party agrees to provide assistance, it should notify the requesting party as to the equipment and peace officer personnel which will be engaged in the assistance.

The Commanding Officer of a Participating Jurisdiction may decline the request for assistance if personnel or equipment are not available at the time of the request. No party to this agreement shall be liable for failure to respond to a request for assistance for any reason.
