Common use of Reserve Report Data Clause in Contracts

Reserve Report Data. The oil and gas reserve estimates of the Company and its subsidiaries for the fiscal years ended December 31, 2006, 2005 and 2004 contained in the Registration Statement, the Time of Sale Information and the Prospectus are derived from the books and records of the Company and its subsidiaries, with respect to which the petroleum engineering firms have reviewed the proved reserve estimates associated with at least 80% of the discounted future net cash flows before income taxes for such years, all as set forth in the reports prepared by the petroleum engineering firms; and such reserve estimates fairly reflect, in all material respects, the oil and gas reserves of the Company and its subsidiaries at the dates indicated therein and are in accordance with the Commission guidelines applicable thereto applied on a consistent basis throughout the periods involved.

The oil and gas reserve estimates of the Company and its subsidiaries for the fiscal years ended December 31, 20062011, 2005 2010 and 2004 contained 2009 included or incorporated by reference in the Registration Statement, the Time of Sale Information and the Prospectus are derived from the books and records of the Company and its subsidiaries, with respect to which the petroleum engineering firms have reviewed the proved reserve estimates associated with at least 80% of the discounted future net cash flows before income taxes for such years, all as set forth in the reports prepared by the petroleum engineering firms; and such reserve estimates fairly reflect, in all material respects, the oil and gas reserves of the Company and its subsidiaries at the dates indicated therein and are in accordance with the Commission guidelines applicable thereto applied on a consistent basis throughout the periods involved.
