Common use of Request for Letter of Credit Clause in Contracts

Request for Letter of Credit. Borrower may request issuance of a Letter of Credit by providing, not later than 12:00 noon (Central time) on a Banking Day, a written request therefor (“LC Request”) to the Administrative Agent and the Letter of Credit Bank. The LC Request shall set forth (a) the face amount and expiry date, (b) the beneficiary, (c) the terms thereof, and (d) such other information as the Letter of Credit Bank shall request. Letters of Credit shall be issued under the 5-Year Facility. In no event may the expiry date be later than 364 days past the 5-Year Maturity Date.
