Common use of Replacement of Lost Tools Clause in Contracts

Replacement of Lost Tools. The Employer shall replace Employees’ lost tools under the following conditions: ▪ The tools were stolen; ▪ This occurred in relation to work or a workplace/work-site the Employee attended under the direction of the Employer; ▪ Any claim for lost tools due to theft is accompanied by a police report; ▪ The tools were validated by the Employer in accordance with this clause; ▪ The tools were secured either by: ▪ Being locked in a Company vehicle; or ▪ Being locked in a private vehicle that was situated on or adjacent to work or a work-site the Employee attended under the direction of the Employer; or ▪ Being locked in any locked storage facility situated on the Employer’s premises, workplace, work-site, workshop or lock-up; ▪ The Employer shall not replace lost tools where they were stolen when not securely stored in accordance with one of the methods described in this sub-clause.

The Employer shall replace Employees’ lost tools under that were stolen in accordance with all of the following conditions: ▪ The tools were stolen; ▪ This event occurred in relation to work or a workplace/work-site worksite the Employee attended under the direction of the Employer; ▪ Any claim for lost stolen tools due to theft is accompanied by a police report; ▪ The tools were stolen had been validated by the Employer prior to the theft in accordance with this clause; ▪ The tools were secured either byby being: ▪ Being locked • Locked in a Company vehicle; or ▪ Being locked • Locked in a private vehicle that was situated on or adjacent to work or a work-site worksite the Employee attended under the direction of the Employer; or ▪ Being locked • Secured in any a locked storage facility situated on the Employer’s premises, workplace, work-siteworksite, workshop or lock-up; ▪ The Employer shall not replace lost tools where they were stolen when not securely stored in accordance with one of the methods described in this sub-sub- clause; ▪ Employees are encouraged to provide photographic evidence to support written documentation; and ▪ Replacement of lost tools will be subject to a valid Police Report, and at the discretion of the Insurance Company.

Replacement of Lost Tools. The Employer shall replace an Employees’ lost tools under the following conditions: ▪ o The tools were stolen, as per items below; ▪ o This occurred in relation to work or a workplace/work-site the Employee attended under the direction of the Employer; ▪ employer. o Any claim for lost tools due to theft is accompanied by a police report; ▪ . o The tools were validated by the Employer in accordance with this clause; ▪ . o The tools were secured either by: ▪ Being being locked in a Company company vehicle; or ▪ Being being locked in a private vehicle that was situated on or adjacent to work or a work-site the Employee attended under the direction of the Employer; or ▪ Being being locked in any locked storage facility situated on the Employer’s premises, workplace, work-site, workshop or lock-lock- up; ▪ . o The Employer shall not NOT replace lost tools where whereby they were stolen when not securely stored in accordance with as per one of the methods described in this sub-clauseherein above.

The Employer shall replace Employees’ lost tools under the following conditions: ▪ The tools were stolen; ▪ This occurred in relation to work or a workplace/work-site the Employee attended under the direction of the Employer; ▪ Any claim for lost tools due to theft is accompanied by a police report; ▪ The tools were validated by the Employer in accordance with this clause; ▪ The tools were secured either by: ▪ Being locked in a Company vehicle; or ▪ Being locked in a private vehicle that was situated on or adjacent to work or a work-site the Employee attended under the direction of the Employer; or ▪ Being locked in any locked storage facility situated on the Employer’s premises, workplace, work-site, workshop or lock-up; ▪ The Employer shall not replace lost tools where they were stolen when not securely stored in accordance with one of the methods described in this sub-clause; ▪ The Employer has an insurance policy that covers each Employee for $2,000 worth of tools (with a limit of $1,000 per item). This policy amount will be the limit of any reimbursement for tools lost due to theft.
