Common use of Replacement and Repair Clause in Contracts

Replacement and Repair. When any Work is modified, adjusted, repaired, replaced or re-performed, such Work shall be subject to the same warranties, the same conditions and the same remedies provided for the original Work, provided the warranty period for such Work shall begin on the date the modification, adjustment, repair, replacement or re-performance is complete. Any defective or non-conforming Work shall be removed from Purchaser’s Site if necessary. Contractor shall bear the cost of making good all work of separate contractors destroyed or damages by such removal or correction.
