Common use of Repayment of Credits or Waived Charges Clause in Contracts

Repayment of Credits or Waived Charges. If Sprint terminates a Service or the Agreement due to End User’s material breach, or End User terminates a Service or the Agreement before the end of any applicable Order Term or Minimum Service Term (unless due to Sprint’s material breach), End User will repay Sprint a pro rata portion of any credits issued or charges waived, based upon the number of months remaining in the Order Term or Minimum Service Term at the time of termination. This provision does not apply to service level credits issued by Service outages.
