Common use of Remaining Assets Clause in Contracts

Remaining Assets. After the payment to the holders of the Series C Preferred Stock, Series B Preferred Stock and Common Stock of the full preferential amounts specified above, the entire remaining assets of the Corporation legally available for distribution by the Corporation shall be distributed with equal priority and pro rata among the holders of the Junior Securities in proportion to the number of shares of Junior Securities held by them.

Remaining Assets. After the payment to the holders of the Series C A Convertible Preferred Stock, Series B Preferred Stock and Common Stock of the full preferential amounts specified above, the entire remaining assets of the Corporation legally available for distribution by the Corporation shall be distributed with equal priority and pro rata among the holders of the Common Stock, or any other Junior Securities Stock as applicable, in proportion to the number of shares of Common Stock or such Junior Securities Stock held by them.

After the payment to the holders of the Series C B Preferred Stock, Series B C Preferred Stock and Common Stock of the full preferential amounts specified above, the entire remaining assets of the Corporation legally available for distribution by the Corporation shall be distributed with equal priority and pro rata among the holders of the Junior Securities in proportion to the number of shares of Junior Securities held by them.

Remaining Assets. After the payment to the holders Holders of the Series C Preferred Stock, Series B Preferred Stock and Common Series B1 Preferred Stock of the full preferential amounts specified above, the entire remaining assets of the Corporation legally available for distribution by the Corporation shall be distributed with equal priority and pro rata among the holders of the Junior Securities Common Stock and other junior securities in proportion to the number of shares of Junior Securities Common Stock and junior securities held by them.

Remaining Assets. After the payment to the holders Holders of Series B Preferred of the full preferential amounts specified above and the Series C Preferred Stock, of the amounts required by the Series B C Preferred Stock and Common Stock of the full preferential amounts specified aboveDesignation, the entire remaining assets of the Corporation legally available for distribution by the Corporation shall be distributed with equal priority and pro rata among the holders of the Junior Securities in proportion to the number of shares of Junior Securities held by them and the holders of Common Stock in proportion to the number of shares of Common Stock held by them.
