Common use of Release of Liability Clause in Contracts

Release of Liability. I understand that skiing in its various forms, including snowboarding, involves risks, dangers, and hazards that may cause serious personal injury or death and that injuries are a common and ordinary occurrence. Risks include, but are not limited to, changes in terrain, weather and snow surfaces, ice, moguls, bare spots, rocks, stumps, debris, fences, posts, trees, lift equipment and towers, the operation of chairlifts, and chairlift loading, riding, and unloading operations, including the presence or absence of restraint bars on the chairs, light poles, signs, buildings, ramps, roads and walkways, rollers and terrain features, including rails, bonks, boxes, corrugated pipes, cylinders, dance floors, wall rides, table top, step up and step down jumps, hips and other forms of jumps, including their height, the location of the start point, and the angle of their approaches and the angle and length of their take-off ramps and landing areas, padded and non-padded obstacles, snowmaking, grooming, and snowmobile equipment and operations, and collisions with other persons and other natural and man-made hazards, including collisions with people and obstacles adjacent to and off the skiable terrain, such as snowmaking pipes, hydrants, guns, wands, and other snowmaking equipment, rocks and trees, and improperly-adjusted and malfunctioning equipment. I acknowledge the risks in the sport of skiing can be greatly reduced by taking lessons, abiding by the Skier Responsibility Code (known as Your Responsibility Code), obeying the Wisconsin Skier Safety Act, and using common sense. For ski rentals, I understand the boot/binding system which I have rented is designed to reduce the risk of certain injuries to the lower leg. It will not release at all times or under all circumstances where a release may prevent injury, nor is it possible to predict every situation in which it will release. I understand the boot/binding system will not reduce the risk of injury to my knees or other parts of my body. I further understand the boot/binding system does not have a backward release capability and will not release or protect any part of my body in the event of a backward fall. I therefore understand the boot/binding system I have rented CANNOT GUARANTEE MY SAFETY. In consideration of the rental of the equipment to me by Sunburst and the use of its facilities, I RELEASE AND FULLY DISCHARGE Xxxxxx Ski Ventures, LLC d/b/a Sunburst, and eco Land Holdings, LLC, their owners, officers, shareholders, agents and employees (collectively the “SUNBURST RELEASEES”) from any liability resulting from any personal injury to myself, including death, which is caused by any NEGLIGENT ACT OR OMISSION of any SUNBURST RELEASEE, with respect to: • the selection, installation, adjustment, inspection, maintenance and repair of the rental equipment; • the design, location, construction, inspection, and maintenance of trails, ski runs, and slopes, including their grooming and modifications to their natural steepness and pitches; • the design, location, construction, inspection, and maintenance of rails, boxes, tube jams, table tops and other jumps, including their height, their start location, the angle of their approaches and the angle and length of their take-off ramps and landing areas; • the loading, riding, and unloading of surface lifts; • grooming, snowmaking, and snowmobile equipment and operations; • the operation of chairlifts, and chairlift loading, riding, and unloading operations, including the presence or absence of restraint bars on the chairs; • the padding or non-padding of natural and man-made obstacles and hazards on, adjacent to, or off the skiable terrain; • the posting or failure to post warnings, signs, and the construction of fences or other barriers, including the selection of the construction materials, or the failure to construct fences or other barriers; • the classification and labeling of trails, ski runs, and terrain features; and • the presence of snowmaking pipes, hydrants, guns, wands, other snowmaking equipment, light posts, rocks, and trees adjacent to the ski runs. I accept full responsibility for any personal injury which may result from use of the rental equipment, and I hereby HOLD HARMLESS the SUNBURST RELEASEES for any personal injury sustained by me, including death, while using the rental equipment, caused by the negligence of any SUNBURST RELEASEE. I agree not to bring any action or lawsuit against any SUNBURST RELEASEE for any personal injury caused by the NEGLIGENCE of any SUNBURST RELEASEE. I understand that for a fee of $25.00 in addition to the normal rental price, Sunburst offers an optional Rental Agreement that does not require me to sign a release of liability. In signing this Release of Liability, I acknowledge I am aware of this option offered by Xxxxxxxx and hereby waive my right to purchase the same. In accordance with Wisconsin law, nothing in this Release of Liability should be construed as releasing, discharging or waiving any claims I may have for reckless or intentional acts on the part of any SUNBURST RELEASEE. In the event I am signing as a parent or guardian of a minor, I represent I have full authority to do so, realizing this Release of Liability is binding upon the minor as well as myself. Release of Liability. I understand the sports of skiing, snowboarding and snow tubing, ("Recreational Snow Sports") involve inherent risks of INJURY and DEATH. I voluntarily agree to expressly assume all risks of personal injury that may result from participating in Recreational Snow Sports, which are related in any way to the use of this equipment. I understand that skiing in its various forms, including snowboarding, and snow-tubing involves risks, dangers, and hazards that may cause serious personal injury or death and that injuries are a common and ordinary occurrence. For ski rentals, .I understand the boot/binding system which I have rented is that a helmet designed to for Recreational Snow Sports use will help reduce the risk of certain some types of injuries to the lower leguser. It will not release at all times I recognize that serious injury or under all circumstances where death can result from both low- and high-energy impacts, even when a release may prevent injury, nor helmet is it possible to predict every situation in which it will releaseworn. I understand that no helmet can protect the boot/binding system will not reduce user against every foreseeable impact to the risk head, and that Recreational Snow Sports present unavoidable and inherent risks of injury which surpass the limits of protection offered by this helmet. I understand this helmet does not protect against trauma to my knees or any other parts part of my body. I further understand the boot/binding system does not have a backward release capability , including my neck, face and spine, and that these limitations are UNAVOIDABLE AND INHERENT RISKS of any activity in which this helmet will not release or protect any part of my body in the event of a backward fall. In consideration of the rental of the equipment to me by Sunburst and the use of its facilitiesGreat Bear, I RELEASE AND FULLY DISCHARGE Xxxxxx Ski VenturesGREAT BEAR RECREATION PARK, LLC d/b/a Sunburst, and eco Land Holdings, LLCINC., their owners, officers, shareholders, agents agents, and employees (collectively the “SUNBURST GREAT BEAR RELEASEES”) from any liability resulting from any personal injury to myself, including death, or damage to my property which is caused by any the BREACH OF ANY EXPRESS OR IMPLIED WARRANTY or the NEGLIGENT ACT OR OMISSION of any SUNBURST GREAT BEAR RELEASEE, with respect toincluding any NEGLIGENT ACT OR OMISSION in: • the selection, installation, adjustment, inspection, maintenance, repair or rental of the equipment. • instructions given or not given to me concerning the equipment or its use; • the design, layout, location, construction, inspection, maintenance and or repair of trails, ski runs and slopes; • grooming, snow making, snowmobile operations, the rental equipmentoperation of chair lifts and surface lifts, and chair lift and surface lift loading and unloading operations; • the design, location, construction, inspection, maintenance and maintenance repair of trails, ski runs, and slopesterrain features, including their grooming and modifications to their natural steepness and pitches; • the designrails, location, construction, inspection, and maintenance of railshalf pipes, boxes, tube jams, table tops top and other jumps, forms of jumps including their heightapproaches, their start location, the angle of their approaches and the angle and length of their take-off ramps ramps, and landing areas; • the loading, riding, and unloading of surface lifts; • grooming, snowmaking, and snowmobile equipment and operations; • the operation of chairlifts, and chairlift loading, riding, and unloading operations, including the presence or absence of restraint bars on the chairs; • the padding or non-padding of natural and man-made obstacles and hazards on, adjacent to, or off the skiable terrainhazards; • the posting or failure to post warnings, warnings or signs, and the construction of or failing to construct fences or other barriers, including the selection of the construction materials, or the failure to construct fences or other barriers; • the classification and labeling of trails, ski runs, runs and terrain features; and • the presence of snowmaking pipes, hydrants, guns, wands, other snowmaking equipment, light posts, rocks, and trees adjacent to the ski runs. I accept full responsibility for any personal injury or damages which may result from any engagement in the sport of skiing and snowboarding and/or the use of the rental equipment, and I hereby HOLD HARMLESS the SUNBURST GREAT BEAR RELEASEES for any personal injury or damage sustained by me, including death, while using the rental equipment, caused by the negligence of any SUNBURST RELEASEE. I agree not to bring any action or lawsuit suit against any SUNBURST GREAT BEAR RELEASEE for any personal injury caused by the NEGLIGENCE of any SUNBURST RELEASEE. I acknowledge that that snow shoeing can be a high active sports activity and that persons who have bad backs, necks, shoulders, knees, joints, broken bones, heart or lung problems, pregnancy or other conditions should not participate in this activity. I have made a voluntary choice to participate in this activity despite the risks that it presents. In consideration of my being permitted to participate this activity and renting equipment I FREELY ACCEPT AND ASSUME ALL RISKS OF INJURY ASSOCIATED WITH THESE ACTIVITIES. For ski rentalsIn downhill skiing, I understand the boot/binding system which I have rented my child may rent is designed to reduce the risk of certain injuries to the lower leg. It will not release at all times or under all circumstances where a release may prevent injuryinjury to my child, nor is it possible to predict every situation in which it will release. I understand the same boot/binding system will not reduce the risk of injury to my child’s knees or other parts of my child’s body. I further understand the same boot/binding system does not have a backward release capability and will not release or protect any part of my child’s body in the event of a backward fall. I accept full responsibility for any personal injury to my child which may result from the use of the rental rented equipment, the purchase of a lift ticket, or the participation in the sport, and I hereby HOLD HARMLESS the SUNBURST MONT DU RESORT RELEASEES for any personal injury sustained by memy child, including death, while using the rental equipmentrented equipment or the purchased lift ticket, or participating in the sport caused by the negligence of any SUNBURST MONT DU LAC RESORT RELEASEE. Type II - Ski Moderately • Prefer a variety speeds. • Prefer to ski on varied terrain. • Skiers not classified as either Type I or the failure Type III. • Favor average release/retention settings appropriate for recreational skiing. I accept full responsibility for any personal injury or damage which may result from use of the rental equipment, and I hereby HOLD HARMLESS the SUNBURST TYROL BASIN RELEASEES for any personal injury or damage sustained by me, including death, while using the rental equipment, caused by the negligence of any SUNBURST RELEASEE. I accept full responsibility for any injury or damage which may result from the participation in the Tyrol Basin Ski School and its classes, instructions or lessons, and I hereby HOLD HARMLESS the TYROL BASIN RELEASEES for any injury or damage sustained by me, including death, while participating in the Tyrol Basin Ski School. It will not release at all times or under all circumstances where a release may prevent injury, nor is it possible to predict every situation in which it will release. I further understand the boot/boot binding system does not have a backward release capability and will not release or protect any part of my body in the event of a backward fall.
