Questionable Activities. Neither ERC nor any ERC Sub that owns a Retirement Community has directly or indirectly: (a) made any unlawful contribution, gift, entertainment, bribe, kickback, rebate, payoff or other payment to any Person in connection with the Business; (b) established or maintained any unlawful or unrecorded fund of any such ERC Company monies or other assets; or (c) made any false or fictitious entry on the books or records of any such ERC Company.
Questionable Activities. If any question exists regarding whether historic, current, or new practices or activities are permitted or would be inconsistent with the Conservation Purposes or would impair the Conservation Values, Grantor shall notify Grantee and Caltrans in writing and obtain Grantee’s and Caltrans’ written approval prior to engaging in such practices or activities.
Questionable Activities. If any question exists regarding whether historic, current, or new practices or activities are permitted or would be inconsistent with the Conservation Purposes or would diminish or impair the Conservation Values, the Grantor shall notify the Foundation in writing and obtain the Foundation’s written approval prior to engaging in such practices or activities.
