Quality Performance Scoring. 1. CMS shall use the ACO’s performance on each of the quality measures to calculate the ACO’s total quality score according to a methodology to be determined by CMS prior to the start of each Performance Year. 2. Prior to the start of each Performance Year, CMS shall notify the ACO of the methodology for calculating the quality performance benchmarks and the methodology for calculating the ACO’s total quality score for that Performance Year. Notwithstanding Section XXI.D, CMS may amend these methodologies without the consent of the ACO prior to the beginning of each Performance Year. 3. Starting in the ACO’s second Performance Year in the Model, the ACO’s quality score may be adjusted downward based on quality measure validation (“QMV”) findings. Prior to the start of the ACO’s second Performance Year and each subsequent Performance Year, CMS will provide additional information regarding how the quality score will be adjusted based on the QMV findings.
