Protection of SJHC Site Facilities. (a) Project Co shall protect the SJHC Site Facilities from damage which may arise in the course of the performance by Project Co of the Works. (b) Should Project Co, in the performance of the Works, damage any SJHC Site Facilities (other than as required or contemplated by the Output Specifications), Project Co shall be responsible to Make Good such damage at Project Co’s expense without delay. (c) The Independent Certifier shall be provided with a copy of the building condition assessment of the east end of the existing SJHC hospital building to be provided under the Output Specifications including any related ongoing monitoring documentation. Project Co shall advise SJHC and the Independent Certifier upon becoming aware that any possible damage has occurred to any of the SJHC Site Facilities (other than as required or contemplated by the Output Specifications). In such event the Independent Certifier shall investigate such damage and shall prepare a report and shall provide such report to the Works Committee, the Project Co Representative and the SJHC Representative, all on an expeditious basis. The report shall include the determination of the Independent Certifier as to whether Project Co is responsible to Make Good such damage in accordance with Section 18.12(b). (d) Should damage occur to the SJHC Site Facilities which has been determined not to be the responsibility of Project Co, SJHC may direct Project Co to Make Good such damage under a Variation in accordance with Schedule 22 – Variation Procedure.
