Proposed Alterations. The parties acknowledge and agree that the purpose of this Amendment is to add additional portions of the land comprising the Storage Facility to the Leased Premises in order to allow Tenant, if it elects to do so, to construct some or all of the Proposed Alterations (as such term is defined in the Lease) and related equipment and facilities, including additional storage tanks and related piping, on the Leased Premises (collectively, the “New Facilities”). If Tenant constructs any of the New Facilities, Tenant covenants and agrees that (a) Tenant will obtain and receive, all necessary approvals, authorizations, consents, rights-of-way, easements and permits (environmental or otherwise) required to construct, own or operate the New Facilities on the Leased Premises, (b) the construction, ownership and operation of any New Facilities on the Leased Premises will be in accordance with the terms and conditions of the Lease and applicable Laws, (c) all new tanks constructed by Tenant and associated with the New Facilities will be and will continue to be certified pursuant to the American Petroleum Institute’s Aboveground Storage Tank Inspector Certification Program under API 653, and (d) the New Facilities will comply with accepted industry practices and standards with respect to health, safety, security and the environment. Landlord will have the right (but not the obligation), at any reasonable time and from time to time, to inspect the progress of the construction of the New Facilities and the operation thereof in order to confirm that those New Facilities are or will be completed, owned and operated in accordance with applicable Laws and accepted industry practices and standards with respect to health, safety, security and the environment.
Proposed Alterations. Landlord hereby approves of the proposed Subtenant alterations described in Exhibit D to the Sublease ("Preliminary Plans"); provided, however, that the parties hereto acknowledge that such Preliminary Plans do not consist of final, detailed construction drawings and accordingly, Landlord hereby reserves its right to review and approve, in accordance with Section 9 of the Lease, the final construction drawings for such alterations ("Final Construction Drawings"); provided further that Landlord shall only have the right to disapprove such Final Working Drawings to the extent the same are not a logical extension of, or are otherwise materially inconsistent with, the Preliminary Plans. Based upon the Preliminary Plans, Landlord does not anticipate requiring the removal of any of the alterations described therein at the end of the term of the Sublease.
Proposed Alterations. ▪ Maintaining enclosed front porch (final design dependent on further site investigations). ▪ Constructing top landing for porch stairs to suit location of entry door and adding (black) metal "Code" railing inboard of reconstructed stair side wall (see historic photos). ▪ Revising size and location of main floor windows on south and west elevations to suit new interior layouts. ▪ Revising size and location of lower floor windows on all elevations but maintaining original/traditional intent of vertical alignment with main floor windows, where possible. Main floor windows consistently taller than lower floor windows per original design. ▪ Lowering grade around south and west elevations as required to suit site redevelopment (historic grade relationship maintained at street facades). ▪ Addition of lower floor suite entry door and porch roof to west elevation using existing building design volcabulary.
