Common use of Program Participation Terms Clause in Contracts

Program Participation Terms. ‌ Upon entering the Agreement, each Participating Contractor shall commit to promoting GJGNY Loans. The Contractor acknowledges this Agreement is completely voluntary. NYSERDA may deny an Applicant’s approval or terminate a Participating Contractor from offering GJGNY Loans, including failure to maintain standards, poor performance, unresponsiveness or inappropriate behavior. In all cases involving a Contractor’s participation status, NYSERDA’s written decision is final. As a condition for offering GJGNY Loans and associated benefits, each Applicant and Participating Contractor understands and agrees to the terms and conditions outlined in this Agreement and any GJGNY Loan Announcements distributed and/or posted by NYSERDA or an Implementation Contractor.
