Processing of claim In case of a separation (including retirement) claim under this Group Policy the Accrued Gratuity shall be paid out as per the instructions of the Group Policy Holder received by the Company in the form of the duly filled Employer’s Declaration Form. Such payment of Benefits shall be subject to the stipulations mentioned under the Article 8.11. For a claim arising out of the death of a Member covered under this Group Policy, the Accrued Gratuity shall be paid in accordance with the process mentioned hereinabove. In case of a claim arising out of the Death of an Insured Member, the Group Life Cover amount for the Member concerned shall be paid or repudiated giving all the relevant reasons, within 30 days from the date of receipt of all required documents and clarifications for the purpose of settlement of the claim. However, where the circumstances of a claim warrant an investigation in the opinion of the Company, it shall initiate and complete such investigation at the earliest, which shall be done in no case later than 6 months from the date of receipt of primary documents. 6.8

  • Sub-processing 1. The data importer shall not subcontract any of its processing operations performed on behalf of the data exporter under the Clauses without the prior written consent of the data exporter. Where the data importer subcontracts its obligations under the Clauses, with the consent of the data exporter, it shall do so only by way of a written agreement with the sub-processor which imposes the same obligations on the sub-processor as are imposed on the data importer under the Clauses. Where the sub-processor fails to fulfil its data protection obligations under such written agreement the data importer shall remain fully liable to the data exporter for the performance of the sub-processor’s obligations under such agreement.

If payment for the shares purchased is not received within three days after the date of confirmation the sale may be cancelled forthwith, by us or by the respective Funds, without any responsibility or liability on our part or on the part of the Funds, and we and/or the respective Funds may hold you responsible for any loss, expense, liability or damage, including loss of profit suffered by us and/or the respective Funds, resulting from your delay or failure to make payment as aforesaid.
