Process for Payment. Upon Commencement of Operations (as described in above Section 3.03), Developer may request a Performance Rebate Payment for an applicable Qualified Hard Cost by written application submitted to the City. The City shall not be required to make a Performance Rebate Payment for any applicable Qualified Hard Cost until: a. the Developer submits to the City a payment request (the “Economic Development Incentive Payment Request”) together with all information required to verify Developer’s material compliance with its obligations under this Agreement for City’s rebate of the Qualifying Hard Cost; and
