Common use of Procedure B Clause in Contracts

Procedure B. Operator shall contract the supplier of goods and services with the best qualified contractor according to cost and quality criteria, being prohibited from paying in installments for the acquisition of the same good or service, and the Operational Committee must be informed of the contract within 30 (thirty) days of date of conclusion of the respective contract. 3.28.1. When the supplier winning an engagement procedure B is an Affiliate of any of the Contracted Parties, the Operating Committee’s prior approval is required. 3.28.2. If the Operator finds a market situation in which there are less than 3 (three) suppliers for the contracting of a good or service, the Operator must make available to the other Consortium Members a preliminary list of participants in the contracting procedure, which must be completed with indications from any of the Consortium Members upon request to the Operator within a maximum period of 15 (fifteen) days from the receipt of the preliminary list. 3.28.3. Any Consortium Member may have access to a copy of the agreements executed by the Operator upon request.
