Common use of Priority of Provisions Clause in Contracts

Priority of Provisions. If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit attached hereto, any document or events referred to herein, or any document incorporated into this Agreement by reference and a term, statement, requirement, or provision of this Agreement, the term, statement, requirement, or provision contained in Articles 1-12 of this Agreement shall prevail and be given effect.

Priority of Provisions. If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit attached hereto, any document or events referred to referenced herein, or any document incorporated into this Agreement by reference and a term, statement, requirement, or provision of Articles 1 through 15 of this Agreement, the term, statement, requirement, or provision contained in Articles 1-12 of this Agreement 1 through 15 shall prevail and be given effect.

Priority of Provisions. If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit attached hereto, any document or events referred to herein, or any document incorporated into this Agreement by reference and a term, statement, requirement, or provision of this Agreement, the term, statement, requirement, or provision contained in Articles 1-12 11 of this Agreement shall prevail and be given effect.

Priority of Provisions. If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit attached hereto, any document or events referred to herein, or any document incorporated into this Agreement by reference and a term, statement, requirement, or provision of Articles 1 through 9 of this Agreement, the term, statement, requirement, or provision contained in Articles 1-12 of this Agreement 1 through 9 shall prevail and be given effect.

Priority of Provisions. If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit attached hereto, any document or events referred to herein, or any document incorporated into this Agreement by reference and a term, statement, requirement, or provision of Articles 1 through 8 of this Agreement, the term, statement, requirement, requirement or provision contained in Articles 1-12 of this Agreement 1 through 8 shall prevail and be given effect, except for a Modification (as defined in Section 8.16 below) which shall govern.

Priority of Provisions. If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit attached hereto, any document or events referred to herein, or any document incorporated into this Agreement by reference and a term, statement, requirement, or provision of this Agreement, the term, statement, requirement, or provision contained in Articles 1-12 1 through 11 of this Agreement shall prevail and be given effect.

If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit attached hereto, any document or events referred to herein, or any document incorporated into this Agreement by reference and a term, statement, requirement, or provision of Articles 1 through 26 of this Agreement, the term, statement, requirement, or provision contained in Articles 1-12 of this Agreement 1 through 26 shall prevail and be given effect.

Priority of Provisions. 20.22.1 If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit attached hereto, any document or events referred to herein, or any document incorporated into this Agreement by reference and a term, statement, requirement, or provision of this Agreement, the term, statement, requirement, or provision contained in Articles 1-12 1 through 20 of this Agreement shall prevail and be given effect.

Priority of Provisions. If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit attached hereto, any document or events referred to herein, or any document incorporated into this Agreement by reference and a term, statement, requirement, or provision of Articles 1 through 10 of this Agreement, the term, statement, statement requirement, or provision contained in Articles 1-12 of this Agreement 1 through 10 shall prevail prevail, and be given effect. The Agreement and Exhibits supersede the documents incorporated by reference. The order of priority shall be the Agreement, Exhibits, then CABCONNECT’S proposal.

If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit attached hereto, any document or events referred to herein, or any document incorporated into this Agreement Contract by reference and a term, statement, requirement, or provision of this AgreementContract, the term, statement, requirement, or provision contained in Articles 1-12 of this Agreement Contract shall prevail and be given effect.

If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit Exhibit attached hereto, any document hereto or documents or events referred to herein, or any document incorporated into this Agreement by reference and a term, statement, requirement, or provision of this Agreement, the term, statement, requirement, or provision contained in Articles 1-12 1 through 76 of this Agreement shall prevail and be given effect.

If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit Exhibit attached hereto, any document hereto or documents or events referred to herein, or any document incorporated into this Agreement by reference and a term, statement, requirement, or provision of this Agreement, the term, statement, requirement, or provision contained in Articles 1-12 1 through 75 of this Agreement shall prevail and be given effect.

If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit attached hereto, any document or events referred to herein, or any document incorporated into this Agreement by reference and a term, statement, requirement, or provision of Articles 1 through 11 of this Agreement, the term, statement, requirement, or provision contained in Articles 1-12 1 through 11 of this Agreement shall prevail and be given effect.

Priority of Provisions. If there is a conflict or inconsistency between any term, statement, requirement, or provision of any exhibit attached hereto, any document or events referred to herein, or any document incorporated into this License Agreement by reference reference, and a term, statement, requirement, or provision of this License Agreement, the term, statement, requirement, or provision contained in Articles 1-12 of this License Agreement shall prevail and be given effect.
