Common use of Prescribed Holidays Clause in Contracts

Prescribed Holidays. a) An Employee, other than a casual Employee is entitled to payment at the Employee’s normal ordinary hourly rate of pay for the following public holidays: • New Year’s Day • Australia Day • Good Friday • Easter Monday • Anzac Day • King’s Birthday • Labour Day • Christmas Day • Boxing Day or such other day(s) proclaimed or gazetted in addition to or in substitution for any of the above days in which case the substituted day will be deemed to be the holiday for the purposes of this Agreement. Employees are entitled to such payment for any day that is a gazetted public holiday, including where the public holiday falls on a Saturday or Sunday. b) Subject to clause 28, in addition the first Monday in December of each year shall be the picnic day which for the purposes of this Agreement will be a public holiday. c) For the avoidance of doubt, an employee who is a permanent part-time employee, is entitled to receive a full day’s payment for the public holiday(s) irrespective of the days worked.
