Prejudgment Remedy Waiver. The Mortgagor represents, warrants and acknowledges that the transaction of which this Mortgage is a part is a commercial transaction and not a consumer transaction. Each and every such loan or advance shall be secured by this Mortgage equally with, and with the same priority as, the original indebtedness secured hereby; provided, however, that (i) no advance shall cause the principal amount of the Obligations secured hereby to exceed the amount set forth above; and (ii) the time of repayment thereof shall not exceed the maturity of the original Indebtedness secured hereby as stated above. The Revolving Loans secured by the Mortgage is a variable interest rate loan as more particularly described in the Financing Agreement and the Note but changes in the interest rate will not affect the maximum term of the Revolving Loans or the Maturity Date. This Mortgage is made upon THE STATUTORY CONDITIONS. If the Revolving Loans and all other obligations shall be fully paid in accordance with its terms and if all of the covenants and agreements of Mortgagor under the Note, this Mortgage, the Financing Agreement and the other Loan Documents shall be fully and faithfully performed, observed and complied with, and if the Financing Agreement shall be terminated as it relates to the Mortgaged Property as shall be evidenced by a release of this Mortgage duly executed by Mortgagee and recorded in the Land Records, then this Mortgage shall be void but otherwise it shall remain in full force and effect.
