Pre-Completion Acceptance Clause Samples
The Pre-Completion Acceptance clause allows a party, typically the buyer or client, to accept part or all of the work or deliverables before the entire project or contract is fully completed. In practice, this means that if certain sections or milestones of a project are finished ahead of schedule, the client can inspect and formally accept those portions, even while other work is ongoing. This clause helps facilitate phased handovers, enables earlier use or occupancy of completed sections, and can trigger partial payments or warranties, thereby providing flexibility and efficiency in project management.
Pre-Completion Acceptance. If the Delivery Date has not occurred within the Construction Period, Tenant shall have the right, but shall not be obligated, to accept delivery of the Premises, without relieving Landlord of any obligation to fully complete Landlord's Work. If Tenant accepts delivery of the Premises prior to the completion of Landlord's Work, Landlord shall complete Landlord's Work, including completing any Punchlist Items, as soon as possible, and in so doing shall not unreasonably interfere, and shall cause its contractors not to unreasonably interfere, with the fixturing, furnishing, equipping and stocking of the Premises by Tenant and its contractors. Notwithstanding the foregoing, once (i) Tenant has taken possession of the Premises and Landlord has completed Landlord's Work, (ii) all Punchlist Items have been completed, and (iii) all warranties have been assigned to Tenant, Landlord shall have no further construction obligations hereunder.
Pre-Completion Acceptance. The Owner shall have the right to take possession of and use any completed portions of the Work, although the time for completing the entire Work or such portions may not have expired, but such taking possession and use shall not be deemed an acceptance of any Work not completed in accordance with the Contract Documents.
