Common use of Powers and authority Clause in Contracts

Powers and authority. It has the power: (a) to enter into and comply with all obligations expressed on its part under the Finance Documents; and (b) (in the case of a Borrower) to borrow under this Agreement; and (c) (in the case of a Guarantor) to give the guarantee in Clause 14 (Guarantee), and has taken all necessary actions to authorise the execution, delivery and performance of the Finance Documents to which it is a party.

Powers and authority. It has the powerpower to: (a) to enter into and comply with with, all obligations expressed on its part under the Finance Documents; and; (b) (in the case of a Borrower) to borrow under this Agreement; and (c) (in the case of a Guarantor) to give the guarantee in Clause 14 (Guarantee), and has taken all necessary actions to authorise the execution, delivery and performance of the Finance Documents to which it is a partyDocuments.
