Power Utilization Clause Samples

The Power Utilization clause defines how electrical power is to be used, managed, or allocated within the context of an agreement or facility. It typically outlines the permitted levels of power consumption, any restrictions on usage, and may specify requirements for monitoring or reporting energy use. For example, it might set maximum allowable power draw for equipment or require the installation of metering devices. The core function of this clause is to ensure efficient and safe use of electrical resources, prevent overloading, and allocate responsibility for energy costs or compliance with regulations.
Power Utilization. For each month the Authority provides Electric Service to the Customer, the Customer shall utilize the entire Allocation, as represented by the Billing Demand (as such term is described in Service Tariff No. WNY-2), provided, however, that if only part of the Allocation is being utilized in accordance with Schedule C, the Customer shall utilize such partial amount of the Allocation.
Power Utilization. This Section 14 shall apply with respect to all colocation-related Service provided to Customer pursuant to this Agreement. For colocation-related Service provided on a per cabinet basis, in the event that Customer’s sustained power utilization exceeds 5,000 ▇▇▇▇▇ per cabinet, then one of the following must occur as determined by ViaWest: (a) Customer shall purchase additional colocation cabinet space at the then-current rates in order to reduce power utilization below 5,000 ▇▇▇▇▇ per cabinet; (b) ViaWest shall increase Customer’s colocation cabinet and power pricing set forth on the applicable Order Form, at its reasonable discretion, to offset the increased power and data center support costs; or (c) Customer shall decrease its power utilization below 5,000 ▇▇▇▇▇ per cabinet. For colocation-related Service provided on a square foot basis, in the event that Customer’s sustained power utilization exceeds 120 ▇▇▇▇▇ per square foot, then one of the following must occur as determined by ViaWest: (a) Customer shall purchase additional colocation space at the then-current rates in order to reduce power utilization below 120 ▇▇▇▇▇ per square foot; (b) ViaWest shall increase Customer’s colocation space and power pricing set forth on the applicable Order Form, at its reasonable discretion, to offset the increased power and data center support costs; or (c) Customer shall decrease its power utilization below 120 ▇▇▇▇▇ per square foot.
Power Utilization. When multiple phase service is provided, electric power shall be taken and used so that the current will be balanced equally on all phases. Whenever the difference between the currents shall exceed ten percent (10%) of the total amount taken from any one phase, either at the time of minimum or maximum demand, the load shall be so arranged that the unbalanced condition will not exceed ten percent (10%).
Power Utilization. A record shall be kept monthly by the Customer, and provided on a calendar year basis to the Authority on or before the last day of February following the end of the most recent calendar year, of the maximum demand utilized each month in the West Plant receiving the power covered by the Agreement.
