PHASE III - CONSTRUCTION DOCUMENTS. (a) After Owner’s review and approval of the Phase II – Design Development Documents, the A/E shall prepare the Construction Documents including working drawings and specifications setting forth in detail each discipline’s requirements into a cohesive whole based upon the Design Development Documents and consultations with the CM and the Owner’s Project Director. The A/E shall confirm that all Project design disciplines have been properly coordinated. (b) The Construction Documents shall conform to applicable building codes and zoning codes and accepted construction industry standards. A/E shall signify its responsibility for the Construction Documents by affixing its signature, date and seal as required by Florida Statutes. Where the Agreement provides for Owner’s approval of the A/E’s design recommendations and decisions, this approval does not relieve the A/E of any responsibilities. (c) If the Project meets the definition of a threshold building, the A/E shall prepare and submit to the Owner a copy of the threshold building inspection plan, which shall provide specific inspection procedures and schedules such that the portions of the Project specified within the threshold inspection plan can be adequately inspected for compliance. The inspection plan must be submitted to the Owner with the 100% completed Construction Documents and prior to Owner’s issuance of written authorization for construction to start. (d) A/E shall prepare and provide to Owner all applications, data and documents required to obtain the approval of all authorities having jurisdiction over the Project, including any applicable storm water management districts and State and local fire marshals. This shall be accomplished at the appropriate time, but not later than the ninety percent (90%) completion point of this phase. To ensure the timely approval of all permits necessary for the construction of the Project, including all environmental permits, A/E shall furnish, on a timely basis, such plans, data and information as may be necessary to secure approval of the required permits. A/E shall, at no additional cost to Owner, make all reasonable and necessary revisions to the Construction Documents required to obtain the necessary permit approvals for construction of the Project. (e) The A/E shall consult with CM with respect to (i) CM’s development of the Construction Cost Estimate, (ii) CM’s development of an overall Project Schedule and (iii) CM’s comments and recommendations concerning the Project design. A/E shall approve or provide written comments to CM and to the Project Director within ten (10) business days of receipt of CM’s comments and recommendations. (f) The A/E shall evaluate all product substitution requests by the CM and render decisions in a reasonable time period. (g) A/E shall provide the Project Director with three (3) copies of the Construction Documents, which shall be properly signed and sealed by the A/E. Copies of documents for A/E use are the responsibility of the A/E. (h) Construction Documents prepared by the A/E are subject to Owner’s review and approval. A/E shall respond in writing to Owner’s review comments within fourteen (14) calendar days of receipt and responses shall be forwarded directly to Owner’s Project Director. A/E shall revise the Construction Documents as required by Owner to obtain Owner’s written approval of such documents. (i) Upon approval of the Construction Documents, the A/E shall provide the Project Director with required copies of completed and approved Construction Documents and shall furnish digital copies of all drawings and Specifications to the CM.
