Common use of Performance Standards Clause in Contracts

Performance Standards. 31.1 Verizon shall provide Services under this Agreement in accordance with the performance standards required by Applicable Law, including, but not limited to, Section 251(c) of the Act. 31.2 To the extent required by Appendix D, Section V, “Carrier-to-Carrier Performance Plan (Including Performance Measurements),” and Appendix D, Attachment A, “Carrier-to-Carrier Performance Assurance Plan,” of the Merger Order, Verizon shall provide performance measurement results to NUI. 31.3 NUI shall provide Services under this Agreement in accordance with the performance standards required by Applicable Law.

Performance Standards. 31.1 Verizon shall provide Services under this Agreement in accordance with the performance standards required by Applicable Law, including, but not limited to, Section 251(c) of the Act. 31.2 To the extent required by Appendix D, Section V, “Carrier-to-Carrier Performance Plan (Including Performance Measurements),” and Appendix D, Attachment A, “Carrier-to-Carrier Performance Assurance Plan,” of the Merger Order, Verizon shall provide performance measurement results to NUIBudget Phone. 31.3 NUI Budget Phone shall provide Services under this Agreement in accordance with the performance standards required by Applicable Law.
