Common use of PAYMENT OF ANY EXCESS PORTION OF OVER-ALLOWANCE AMOUNT Clause in Contracts

PAYMENT OF ANY EXCESS PORTION OF OVER-ALLOWANCE AMOUNT. To the extent that the Over-Allowance Amount is One Million Two Hundred Fifteen Thousand Four Hundred Sixty Dollars ($1,215,460.00) or more (such excess to be referred to as the "EXCESS OVER-ALLOWANCE AMOUNT") and/or if as of the Cost Proposal Delivery Date, Tenant fails to meet all of the Financial Standards, and if in either such case, Landlord's lender (who is unaffiliated with Landlord) so requires, Tenant shall pay the Excess Over-Allowance Amount (or if the Financial Standards are not met, then all of the Over-Allowance Amount) in accordance with the procedure specified in this Section 4.3.1.2
