Common use of Payment in Lieu Clause in Contracts

Payment in Lieu. In the event of termination of the Executive’s employment due to the voluntary resignation by the Executive, the Company may, in its sole and absolute discretion, at any time after notice of termination has been given by the Executive, terminate this Agreement, provided that the Company shall pay to the Executive his then current Salary and continue benefits provided pursuant to Section 3(c) for the duration of the unexpired notice period.

Payment in Lieu.
