Common use of Participation in Legal Actions Clause in Contracts

Participation in Legal Actions. At the request of and at the cost of the Trustee, CDOT shall join and cooperate fully in any legal action: in which the Trustee asserts its right to the enjoyment of the Leased Property; that involves the imposition of any charges, costs or other obligations or liabilities on or with respect to the Leased Property or the enjoyment of the Leased Property by the Trustee; or that involves the imposition of any charges, costs or other obligations with respect to the Trustee’s execution, delivery and performance of its obligations under this Site Lease or the Lease, or CDOT’s execution, delivery and performance of its obligations under the Lease. ARTICLE X LIMITS ON OBLIGATIONS

Participation in Legal Actions. (a) At the request of and at the cost of CDOT (payable as Additional Rentals hereunder), the Trustee, CDOT Trustee shall join and cooperate fully in any legal action: (i) in which the Trustee CDOT asserts its right to the enjoyment of the Leased Property; (ii) that involves the imposition of any charges, costs or other obligations or liabilities on or with respect to the Leased Property or the enjoyment of the Leased Property by the TrusteeCDOT; or (iii) that involves the imposition of any charges, costs or other obligations with respect to the TrusteeCDOT’s execution, delivery and performance of its obligations under this Site Lease or the Site Lease, or CDOT’s execution, delivery and performance of its obligations under the Lease.
