Common use of Participating Agency Indemnification of State Clause in Contracts

Participating Agency Indemnification of State. When acting as other than an agent of the State of Wisconsin under this Agreement, and when using the State's or Division's vehicles or equipment, Participating Agency shall indemnify, defend and hold harmless the State, which includes the Department, the Division and all state agencies, and its officers, officials, agents, employees, and members from all claims, suits or actions of any nature, including actions for attorneys’ fees, arising out of the activities or omissions of Participating Agency, its officers, officials, subcontractors, agents or employees.
