Participant Users and Subscribed Users. Participant is responsible for establishing a means to inform its Participant Users and Subscribed Users of notices, changes, information and restrictions applicable to the HIE or to the Direct CRISP Services under this Agreement. Participant shall require that all of its Participant Users and Subscribed Users comply with the applicable requirements of this Agreement and Applicable Law and shall promptly take appropriate action in the event that Participant knows, or reasonably should have known, of a violation of the Agreement by a Participant User or Subscribed User. Participant will be responsible for any breach of this Agreement by a Participant User or a Subscribed User. Participant agrees that notices providedby Participant will be effective as to Participant, Participant Users and Subscribed Users and that Participant will secure Participant Users’ and Subscribed Users’ agreement to the foregoing.

  • Participating Consumers All Participating Consumers as of the Effective Date will continue to be enrolled in the Program under the terms of this ESA unless they opt-out. Contractor shall commit adequate resources to allow timely completion within the project schedule specified in this Agreement.
