Common use of Partial Return of the Development Security Clause in Contracts

Partial Return of the Development Security. If Commercial Operation occurs on or before the Commercial Operation Deadline, but the Demonstrated Contract Capacity is less than the Contract Capacity set forth in Section 1.01(h), then Seller will be entitled to a return of only a portion of the Development Security equal to the product of Sixty dollars ($60) per kilowatt times the kilowatts of Demonstrated Contract Capacity.
