Partes. Los presentes términos y condiciones, incluyendo los expresados en este pedido y cualesquiera otros documentos anexos incluyendo el Programa de Trabajo (denominados en su conjunto Pedido) constituyen un contrato entre AGILENT TECHNOLOGIES Inc. o, en su caso, la entidad del Grupo Agilent mencionada en el anverso del presente (AGILENT) y la entidad o persona reflejada en el espacio titulado “Proveedor” en el anverso de este pedido.
Partes. Los presentes términos y condiciones, junto con aquellos que aparecen en la carátula de esta Orden y cualquier anexo al presente, incluyendo el Estatuto de Trabajo (conjuntamente la “Orden”), constituyen un acuerdo entre AGILENT TECHNOLOGIES, INC., o cualquier otra compañía de Agilent identificada en la carátula de esta Orden, incluyendo cualesquiera subsidiarias (“Agilent”), y la parte identificada en el recuadro identificado como “Emitida a” en la carátula de esta Orden (en lo sucesivo, el “Vendedor”).

Al utilizar su Cuenta ▇▇▇▇▇▇, usted autoriza a Ouro a divulgar o suministrar de cualquier otra forma toda la información y datos necesarios para prestarle los servicios del Programa de Recompensas de Puntos Mas, lo que incluye, a modo de ejemplo, información y datos relacionados con usted y su Cuenta Cambio, transacciones realizadas en virtud de la misma y cualquier sospecha de fraude relacionada con la misma.

  • Hearings The Hearing Officer shall hold hearings on a quarterly basis unless there are no appeals to hear or the parties agree to pend any open appeals. All materials considered in the position review shall be submitted to the Hearing Officer prior to the hearing and neither party will submit evidence at the hearing that was not submitted during the position review. The Hearing Officer shall endeavor to hold multiple hearings each day, and shall issue a concise decision which shall be final and binding. The Hearing Officer shall have no authority to alter the terms and conditions of this contract. Employees may be represented at the hearing and will be released from work with no loss of pay to attend the hearing. The Hearing Officer's fees and expenses shall be shared equally by the parties.

  • Cost of Litigation In case the STATE shall, without any fault on its part, be made a party to any litigation commenced by or against the CONTRACTOR in connection with this Contract, the CONTRACTOR shall pay all costs and expenses incurred by or imposed on the STATE, including attorneys' fees.

  • Hearing The grievance shall be heard by a single arbitrator and both parties may be represented by such person or persons as they may choose and designate, and the parties shall have the right to a hearing at which time both parties will have the opportunity to submit evidence, offer testimony, and make oral or written arguments relating to the issues before the arbitrator. The proceeding before the arbitrator shall be a hearing de novo.

  • GRIEVANCE PROCEDURE AND ARBITRATION 8.01 Any employee or the Union has the right to lodge a grievance with respect to any matter arising out of the interpretation, application or alleged violation of this Agreement. 8.02 At the time formal discipline is imposed or at any stage of the grievance procedure, including the complaint stage, a nurse is entitled to be represented by her/his union representative. In the case of suspension or discharge, the Employer shall notify the nurse of this right in advance. The Employer also agrees, as a good labour relations practice, it will also notify the Bargaining Unit. 8.03 It is the intent of the parties that complaints of employees shall be adjusted as quickly as possible, and it is understood that the Union has no grievance concerning an individual nurse until the Director of Care or her/his designate has been given an opportunity of adjusting the complaint. Such complaint shall be discussed with the Director of Care within fifteen (15) working days after the circumstances giving rise to it have occurred. This discussion may include consultation, advice and assistance from others. If there is no settlement within nine (9) working days, it shall then be taken up as a grievance within nine (9) working days in the following manner and sequence: The Union may present the grievance to the Administrator, or her/his designate, who shall render her/his decision within five (5) working days after the presentation of the grievance to her/him. The parties may, if they so desire, meet to discuss the grievance at a time and place suitable to both parties. If the decision is unsatisfactory, then the grievance may be presented in the following manner: Within ten (10) working days after the decision is given at Step No. 1, the aggrieved employee, and/or the Grievance Committee shall meet with a committee appointed by the Board of Directors of the Manor to consider the grievance. At this stage the employee and/or the Grievance Committee may be accompanied by a representative of the Union. The decision of the committee of the Board of Directors will be rendered in writing to the Labour Relations Officer and the bargaining unit representative within ten (10) working days following such a meeting.

  • Grievance Investigations Where an employee has asked or is obliged to be represented by the Institute in relation to the presentation of a grievance and an employee acting on behalf of the Institute wishes to discuss the grievance with that employee, the employee and the representative of the employee will, where operational requirements permit, be given reasonable leave with pay for this purpose when the discussion takes place in the headquarters area of such employee and leave without pay when it takes place outside the headquarters area of such employee.
